No US federal licence exists for a cannabis shop, so every dispensary below is legal only because its state says so. Adults 21+ can buy in 24 states; Washington, D.C. allows adult possession but not retail sale, and roughly 40 states run a medical program. Verdex lists 6,765 dispensaries, 336 with full profiles. The highest scores today sit in California: Highway DTLA in South Los Angeles and CA Collective in San Jose both hold 9.7. What changes from one state's dispensary to the next

Medical-only markets behave differently. One of the top eight listings, Beyond / Hello on Sansom Street in Philadelphia, is a medical marijuana dispensary, not an adult-use shop.

Federal status changed in 2026, but not at the register. The Justice Department moved state-licensed medical marijuana to Schedule III in April, and on September 9 the D.C. Circuit refused to block that order. Adult-use marijuana is still Schedule I, and taking product across a state line remains a federal crime even between two legal states.

Is it legal to buy weed in every US state?

No. Adult-use stores operate in 24 states, roughly 40 states have medical programs, and the rest have no legal dispensary. Washington, D.C. allows adult possession but not retail sale. Check your state regulator's licence list before you go.

Do dispensaries in every state charge the same tax?

No. State cannabis tax runs from 6% in Missouri to 37% in Washington, and many cities add their own sales or cannabis taxes, according to each state's revenue department. The final price on the receipt depends on the state and the city.

Did federal rescheduling make dispensaries federally legal?

No. In April 2026 the Justice Department moved state-licensed medical marijuana and FDA-approved marijuana products to Schedule III, and the D.C. Circuit declined to stay that order on September 9, 2026. Adult-use marijuana remains Schedule I federally, and state law governs where you can buy.
