How it works

How cannabis is sold in Czechia

The Czech Republic changed its cannabis rules on 1 January 2026. Law 270/2025, adopted on 3 July 2025, amended the Criminal Code and the Addictive Substances Act so that adults aged 21 and over may, for their own use, keep up to 100 grams of cannabis at home and 25 grams elsewhere, and grow up to three plants at a property they own or rent. Going somewhat over those limits, up to 200 grams at home, 50 grams outside or five plants, is an administrative offense; beyond that it is a crime. There is no legal retail market and no licensed social clubs, so cannabis can only be home-grown, and selling or sharing it remains illegal.

Medical cannabis is available as an individually prepared medicine made up in pharmacies. A doctor with a qualifying specialization issues an electronic prescription marked as a highly addictive substance, stating the THC and CBD content. Changes to Decree 236/2015 in force from 1 April 2025 let general practitioners prescribe for chronic intractable pain, allowed prescriptions for up to three months and opened treatment to under-18s in palliative and cancer care. Public insurance pays 90% of the price up to 90 grams of flower (or 30 grams of extract) per three months, with more on the insurer's approval, and maximum prices are capped at 141.88 CZK per gram of flower before VAT. Any pharmacy may dispense without a special licence, though hospital pharmacies are often the easiest to use. Czech licensed growers produced 4,660 kg in 2024, mostly exported to Germany.

Hemp and CBD are legal within limits. Technical hemp is defined as plants yielding no more than 1% THC, and hemp extracts and tinctures up to 1% THC are outside the drug definition if they meet product-safety rules. A plan to regulate low-THC cannabis as a licensed psychomodulatory substance was dropped in 2025 after the European Commission objected; Government Regulation 456/2025, in force from 12 November 2025, covers only kratom. Semi-synthetic cannabinoids have been banned since 2024: HHC, HHC-O and THCP from 6 March 2024, and further derivatives including HHC-P from July 2024.

Drivers are considered impaired at 2 ng/ml of THC in blood under Government Regulation 41/2014.
