Every July, New Mexico's cannabis excise tax goes up by a point. It was 13% until June 30, 2026, is 14% now and is scheduled to reach 18% in 2030, on top of gross receipts tax, according to the state Taxation and Revenue Department. The state does not cap retail licences, and its Cannabis Control Division counted 1,006 approved retailer licences on September 3, 2026.

The purchase cap for adults 21 and older is 2 ounces of flower, 16 grams of concentrate and 800 mg of edibles at a time. Verdex lists 1,127 stores, among them Oasis Cannabis Co. on Coors Boulevard on Albuquerque's West Side, the Dark Matter store on Juan Tabo open 8 a.m. to 10 p.m. daily and A Nice Dream near Uptown, which lists Sundays as closed.

From Albuquerque to the Texas line

Albuquerque holds 352 of our listings and Las Cruces 113, followed by Santa Fe (60), Sunland Park (41), Hobbs (37), Clovis (35) and Farmington (31). Several of the smaller clusters sit at a state edge. Sunland Park adjoins El Paso, and Hobbs and Clovis are near the Texas line, so shops there see out-of-state shoppers who cannot legally take anything home. Carrying cannabis across a state line is illegal even between two legal states.

  • Medical patients: those with a card may buy up to 15 ounces in any 90-day period without the cannabis excise tax, and the Department of Health, not the Cannabis Control Division, issues the cards.
  • Delivery: licensed couriers may deliver. The division counted 56 courier licences on September 3, 2026.
  • Consuming on site: only in a licensed consumption area (28 licences on the same date). Public use can bring a fine of up to $50.

Enforcement is newer than the market. Governor Michelle Lujan Grisham signed HB 10 on April 8, 2025, which created an enforcement bureau inside the division to act against unlicensed operations.
