Possession (no prescription)
Illegal in all states and the Northern Territory; penalties and diversion schemes vary by state. The ACT allows adults limited personal possession (see below).
Prescribed cannabis
Legal when prescribed by a doctor through the TGA Special Access Scheme or Authorised Prescriber pathway and dispensed by a pharmacy. Only Epidyolex and Sativex are registered medicines.
ACT personal use
Since January 31, 2020 adults 18+ in the ACT may possess up to 50 g dried (150 g fresh) and grow 2 plants per person, 4 per household. Sale, supply and public use remain offenses; Commonwealth law is unchanged.
Home grow
Illegal everywhere except the limited ACT allowance; a prescription does not permit cultivation. Commercial cultivation requires Office of Drug Control licences.
Public use
Illegal. Even in the ACT, using cannabis in public or near anyone under 18 is an offense.
Driving
Roadside tests detect THC regardless of prescription. Tasmania has a medical defence since 2017; Victoria's magistrates have had licence-loss discretion for some patients since March 2025; NSW passed a registration-based reform on September 17, 2026, not yet in force.
Advertising
Advertising prescription medicines, including medicinal cannabis, to the public is prohibited under the Therapeutic Goods Act; the TGA issues fines and brings court cases.
CBD products
Low-dose CBD (up to 150 mg a day, adults) was down-scheduled to pharmacist-only in 2021, but no product had been approved for that route by 2026; other CBD requires a prescription.
Age
No statutory minimum for prescriptions, but Medical Board guidance (July 2025) says doctors should avoid prescribing to patients under 18; most clinics accept adults only. ACT personal-use rules apply to 18+.

How cannabis is sold in Australia
Australia runs one of the world's busiest prescription cannabis markets without legalizing recreational use. Medicinal cannabis has been lawful to prescribe since 2016, but only two cannabis medicines, Epidyolex (cannabidiol) and Sativex (nabiximols), are registered on the Australian Register of Therapeutic Goods. Almost everything patients actually use, from dried flower to oils, is an unapproved product that a doctor accesses through the Therapeutic Goods Administration's Special Access Scheme Category B, for one patient at a time, or as an Authorised Prescriber for a class of patients. Pharmacies dispense the medicine, and most products containing THC are Schedule 8 controlled drugs.
Access has become quick and largely online. Telehealth clinics such as Alternaleaf, Candor and Medio assess patients by phone or video for fees from about A$29 to A$99, while in-person clinics such as IvyMed in Adelaide, Releaf in Brisbane and Melbourne, and Naturaleaf in Sydney charge more but may attract Medicare rebates. Specialist dispensaries such as Astrid in Melbourne, Folium in Sydney and MedWest in Perth fill scripts and post them nationwide. Products are not subsidized under the PBS, except Epidyolex for certain epilepsies since May 2021, so patients pay the full retail price. Low-dose CBD was down-scheduled to pharmacist-only in 2021, but no product meeting those rules had been approved by 2026.
Regulators have tightened scrutiny. In July 2025 the Medical Board of Australia and Ahpra published guidance warning against questionnaire-only prescribing, very short telehealth consults and business models that prescribe and dispense a single product; the Pharmacy Board followed in September 2025 with guidance on counselling, quantities and prescription monitoring. Prescription medicines cannot be advertised to the public, which is why clinics speak of alternative or plant-based therapies, and the TGA has fined or sued several companies, including a Federal Court case against Montu Group and Alternaleaf over alleged advertising. The TGA consulted on the framework in August 2025, published its response in February 2026 and, in its 2026–27 business plan, committed to examine reform of how unapproved cannabis products are accessed; no dates had been set by September 2026.
Outside a prescription, cannabis stays illegal in every state and the Northern Territory. The exception is the Australian Capital Territory, where since January 31, 2020 adults may possess up to 50 g of dried cannabis and grow two plants each, although selling remains a crime and federal law is unchanged. Websites and social accounts offering THC vapes or edibles by delivery are illegal sellers and are not listed in our directory.

Is weed legal in Australia?
Not for recreational use, except limited personal possession and home growing by adults in the ACT. Medicinal cannabis is legal nationwide on a doctor's prescription.
How do I get a medicinal cannabis prescription?
Book with a doctor who prescribes through the TGA Special Access Scheme or as an Authorised Prescriber, in person or by telehealth. The doctor decides whether it is appropriate; a consultation never guarantees a script.
Is medicinal cannabis covered by the PBS?
Generally no. Epidyolex has been PBS-listed for certain epilepsies since May 2021; almost all other cannabis products are unapproved and paid for privately.
Can I drive on prescribed medicinal cannabis?
Driving with any detectable THC is still an offense in most states, prescription or not. Tasmania allows a medical defence, Victoria gives magistrates some discretion, and a NSW scheme passed in September 2026 awaits commencement.
Can I buy CBD oil over the counter?
Not yet in practice. Low-dose CBD can legally be pharmacist-only, but no product had been approved for that route as of 2026, so CBD still needs a prescription.
Why don't clinic websites mention cannabis?
Australian law bans advertising prescription medicines to the public, and the TGA fines companies that promote medicinal cannabis, so clinics use terms like alternative therapy.
