Can you smoke inside an Oakland dispensary?

Only at a store that holds a city onsite consumption permit. Oakland Municipal Code 5.80.025 lets an operating dispensary apply for this special permit, and the city holds a public hearing before granting it. In 2022, for example, a hearing officer reviewed a request from Blunts and Moore on 66th Avenue for a patio lounge where guests must pass security and buy on site first.

  1. Public hearing on an onsite consumption permit for a dispensary patio at 701 66th Avenue.

  2. Draft ordinance 25-0176 filed to create stand-alone consumption lounge permits and exempt them from smoking limits.

  3. The lounge ordinance goes back to the City Council's Rules and Legislation Committee.

The lounge ordinance proposes three permit types, but the city page does not show a final vote, so treat stand-alone lounges as pending. Everywhere else, state rules apply: private property with the owner's consent, no use where tobacco smoking is banned, and none in public places.

Oakland's sales tax is higher than San Jose's 10.000%, so the same item costs slightly more here. Medicinal buyers with a state Medical Marijuana ID card are exempt from sales tax, according to CDTFA.
