How cannabis is sold in New Mexico

Yes: adults 21 and older can legally buy, possess and grow cannabis in New Mexico. The Cannabis Regulation Act (HB 2), signed on April 12, 2021, legalized adult possession from June 29, 2021, and licensed stores began adult-use sales on April 1, 2022. The Cannabis Control Division (CCD) of the Regulation and Licensing Department licenses and inspects the commercial market, while the Department of Health issues medical cannabis cards. New Mexico does not cap the number of retail licenses, and CCD's reporting portal counted 1,006 approved retailer licenses, 56 courier licenses and 28 consumption-area licenses as of September 3, 2026.

An adult may buy and carry up to 2 ounces of cannabis, 16 grams of concentrate and 800 mg of edibles at one time, plus six immature plants. There is no limit at home, provided cannabis is stored out of public view. Each adult may grow up to 12 plants, no more than six of them mature, and a household with several adults may have no more than 12 mature plants. Consumption is allowed only in a private residence or a licensed consumption area; using cannabis in public or while driving is illegal, and public use can bring a fine of up to $50. Medical patients may buy up to 15 ounces (425 units) in any 90-day period without the excise tax.

Taxes rise every July. The cannabis excise tax, charged in addition to gross receipts tax, went from 12% to 13% on July 1, 2025 and to 14% on July 1, 2026, and it is scheduled to reach 18% on July 1, 2030, according to the Taxation and Revenue Department. On April 8, 2025, Governor Michelle Lujan Grisham signed HB 10, which created an enforcement bureau inside CCD with powers to investigate and act against illegal cannabis operations.
