How much tax does a San Jose dispensary add?
Roughly a quarter of the shelf price. The California Department of Tax and Fee Administration (CDTFA) sets the cannabis excise tax at 15% of gross receipts from October 1, 2025 through June 30, 2029, after a short stretch at 19% in mid-2025. Sales tax then applies on top, and CDTFA says the excise amount is itself part of the base for sales tax. San Jose's combined sales tax rate is 10.000% as of July 1, 2026.
| Line on the receipt | Rate | On a $50 item |
|---|---|---|
| Shelf price | - | $50.00 |
| Cannabis excise tax | 15% | $7.50 |
| Sales tax (San Jose) | 10.000% of price + excise | $5.75 |
| Total | about 26.5% over shelf | $63.25 |
The city also charges its own cannabis business tax on operators, which is folded into the prices you see rather than shown as a separate line. Medicinal buyers who show a valid state Medical Marijuana ID card and government ID are exempt from sales tax, according to CDTFA.
Which San Jose sellers can you compare on Verdex?
Twelve of the 18 licensed sellers have full profiles with license numbers, hours and ratings. Among them are Airfield Supply Co., The Cake House, Purple Lotus and Off the Charts. Some brands, such as Haze and Purple Lotus, appear under more than one license, so check which location a profile covers before you drive across town.
- Ask for an itemized receipt showing the 15% excise and the sales tax separately
- Match the license number on the Verdex profile with the one posted in the store
- Confirm delivery is coming from the licensed store itself, not an unnamed app menu
- Bring a physical ID; photos of IDs are not enough at most counters
Where can you use it after you buy?
On private property, with the owner's permission. The Department of Cannabis Control (DCC) says cannabis cannot be smoked where tobacco is banned, cannot be used in public places like restaurants and bars, and is off limits within 1,000 feet of schools, day care or youth centers while children are present. In a car it has to stay sealed or in the trunk.
