How cannabis is sold in Wyoming
Wyoming prohibits marijuana in every form. It has no medical program, no decriminalization and no legal market, and it borders Colorado and Montana, where cannabis is legal for adults. Wyoming's laws have not softened as a result; the most active lawmaking of the past few years has gone into restricting hemp.
Possession of up to three ounces is a misdemeanor with up to 12 months in jail and a fine of up to $1,000. More than three ounces is a felony with up to five years and $10,000. Concentrates are treated far more severely by weight: 0.3 grams or less of hashish or liquid concentrate is a misdemeanor, but anything above 0.3 grams is a felony, so a single vape cartridge can carry a felony charge. An extra $500 fine applies for possession within 500 feet of a school, according to NORML.
The only statutory cannabis carve-out is the Hemp Extract Act of 2015 (House Bill 32), which lets a neurologist authorize a preparation with less than 0.3 percent THC and more than 15 percent CBD for treatment-resistant epilepsy. It is not a dispensary system. Retail CBD with 0.3 percent THC or less is legal for buyers 18 and older after Wyoming aligned its hemp law with the 2018 Farm Bill in 2019.
Senate File 32, signed on March 7, 2024 and effective July 1, 2024, redefined hemp to exclude synthetic substances, added delta-8 and analogs to Schedule I and barred sales of hemp products with more than 0.3 percent of these THCs. It followed reports that students in Cody had been sickened by delta-8 products. On October 27, 2025 the Tenth Circuit upheld the law in Green Room v. Wyoming, ruling that the 2018 Farm Bill does not preempt it. A bill to carve out low-dose hemp beverages (HB 267) stalled. The federal hemp changes of November 12 and December 11, 2026 add another layer.

Is delta-8 legal in Wyoming?
