How cannabis is sold in Missouri

Missouri voters legalized adult-use cannabis on November 8, 2022, when Amendment 3 passed with about 53% of the vote. The measure added Article XIV, Section 2 to the state constitution, took effect on December 8, 2022, and licensed stores began selling to adults on February 3, 2023. Medical cannabis had been legal since voters approved Amendment 2 in 2018. Because the rules are in the constitution, lawmakers cannot repeal adult-use sales on their own.

Anyone 21 or older with a government photo ID can shop at a licensed dispensary. The Department of Health and Senior Services says consumers may buy up to 3 ounces in one transaction and possess up to 3 ounces at a time. Adult-use sales carry a 6% state tax, and cities and counties may add up to 3% more with voter approval. Medical patients pay 4% and have higher limits. Article XIV lets dispensaries deliver to a customer's address, and many stores in Kansas City and St. Louis advertise delivery.

Home growing requires a consumer personal cultivation card (the constitution sets a $100 annual fee, indexed to inflation). Cardholders may keep six flowering plants, six non-flowering plants over 14 inches and six under 14 inches, in an enclosed, locked space. Using cannabis in public places remains prohibited, and smoking in public can bring a civil fine of up to $100.

Two 2026 developments matter. On April 23, 2026, Governor Mike Kehoe signed HB 2641. From November 12, 2026, it takes intoxicating hemp products such as THC seltzers off general store shelves, limits them to licensed dispensaries and requires buyers to be 21. A hemp industry coalition filed a federal lawsuit against it in July 2026. A citizen initiative to rewrite Missouri's marijuana rules did not qualify for the November 3, 2026 ballot.
