Florida allows cannabis for medical use only. The program, built on Amendment 2 and section 381.986 of the Florida Statutes, is run by the Department of Health's Office of Medical Marijuana Use (OMMU). Only licensed medical marijuana treatment centers (MMTCs) may grow, process and sell cannabis, and each is vertically integrated. OMMU's weekly update of September 18, 2026 counted 941,650 qualified patients with active ID cards and 781 dispensing locations. Trulieve alone ran 170 of them, followed by MÜV and Curaleaf.
To buy, a patient must be a permanent or seasonal Florida resident, be diagnosed with a qualifying condition by a qualified physician, be entered in the Medical Marijuana Use Registry, and hold a registry ID card. The card costs $75 and must be renewed every year. Since July 27, 2026 an application can only be completed if the patient has a current or scheduled certification with open orders. Physicians must see existing patients at least every 30 weeks. An MMTC may dispense no more than a 70-day supply in 70 days, and smokable flower is capped at 2.5 ounces per 35 days. Patients may hold up to a 70-day supply, or 4 ounces of smokable flower, in original packaging.
Home growing is not allowed, public use is banned, and Florida does not honor medical cards from other states. Medical marijuana and delivery devices are exempt from state sales tax, and MMTCs may deliver to registered patients. Since July 1, 2025, a conviction for trafficking or intent to sell leads to revocation of registry status.
Adult-use legalization remains out of reach for now. The 2026 Smart & Safe Florida initiative fell short of the roughly 880,000 valid signatures it needed, and the Florida Supreme Court declined to hear the campaign's appeal on March 9, 2026, so recreational cannabis will not be on the November 2026 ballot. How much does a Florida medical marijuana card cost?
The registry ID card fee is $75, plus a $2.75 convenience fee for online payment, and the card must be renewed every year. Physician visits are paid separately.
Can tourists buy medical marijuana in Florida?
Only if they qualify as seasonal residents and are registered in Florida. The state does not accept out-of-state medical cards.
How do I check if a Florida dispensary is licensed?
