How cannabis is sold in Maryland

Maryland voters approved adult-use cannabis in the November 2022 election, and legal sales began on July 1, 2023. The Cannabis Reform Act, signed on May 3, 2023, let existing medical dispensaries convert to standard licenses for both medical and adult-use sales. It also created the Maryland Cannabis Administration (MCA) as the regulator. MCA data for August 2026 show 127 dispensary licenses and 78,271 registered medical patients. The median retail price was $7.70 per gram.

Adults 21 and older with a government photo ID, including visitors from other states, may buy and possess the personal-use amount: up to 1.5 ounces of flower, 12 grams of concentrate, or products containing up to 750 mg of THC. Possessing more, up to 2.5 ounces, is a civil offense. A household may grow two plants out of public view, and registered patients may grow two more. Smoking is banned in all public places, including parks, sidewalks, bars and restaurants, and in vehicles. Driving while impaired remains a DUI, and cannabis may not be carried across state lines.

Adult-use sales carry a 12% sales tax, raised from 9% on July 1, 2025 under the Budget Reconciliation and Financing Act of 2025. Medical patients 18+ register through Maryland OneStop with a provider's certification; a plastic ID card costs $25, or patients can print one free. A 2026 law, HB 622, lets standard dispensaries keep delivering medical cannabis through June 30, 2027. Some stores advertise adult-use delivery in certain counties, so check with the store.
