How cannabis is sold in Arizona

Arizona voters approved Proposition 207, the Smart and Safe Arizona Act, on November 3, 2020. The law took effect on November 30, 2020, and the first licensed adult-use sales followed on January 22, 2021; the state register shows many establishment licenses originally issued that day. The Arizona Department of Health Services (ADHS) licenses marijuana establishments and runs the separate medical program, and its AZ Care Check database shows each facility's licenses, hours and inspection history. Many stores in Phoenix and Tucson hold both an establishment license and a medical dispensary license, so they serve recreational customers and registered patients.

Adults 21 and older may possess and transport up to one ounce of marijuana, of which no more than five grams may be concentrate, and may give that amount to another adult without payment. Home growing is allowed: up to six plants at your primary residence, or twelve where two or more adults live, in a locked, enclosed area not visible from public view. Adult-use sales carry a 16% state excise tax on top of the regular transaction privilege (sales) tax; registered patients buying from medical dispensaries are exempt from the excise tax.

Smoking marijuana in a public place or open space is a petty offense, and landlords and employers may set their own rules. Delivery was unlawful until ADHS adopted rules, which state law required by January 1, 2025; several Tucson and Phoenix dispensaries now advertise adult-use delivery. State law also created 26 additional social equity licenses.
