How cannabis is sold in New York

New York legalized adult-use cannabis with the Marihuana Regulation and Taxation Act (MRTA), signed on March 31, 2021. The law lets adults 21 and older possess up to three ounces of cannabis flower or 24 grams of concentrate and store up to five pounds at home, and it allows home cultivation of up to three mature and three immature plants per person, with a household cap of six of each. Legal sales started slowly: the first licensed store, Housing Works Cannabis Co. in Manhattan, opened on December 29, 2022, under the state's first Conditional Adult-Use Retail Dispensary (CAURD) license.

The market is regulated by the Office of Cannabis Management (OCM). OCM publishes every license in a public dataset on data.ny.gov, including addresses, opening dates and hours, and offers a dispensary verification tool. That matters in New York City, where unlicensed smoke shops still sell cannabis; a legal store's name and address should match the OCM list, and license numbers begin with OCM-CAURD or OCM-RETL. Former medical operators, known as Registered Organizations, also hold adult-use dispensary licenses, such as Be. in Brooklyn.

Since June 1, 2024, distributors pay a 9% tax when selling to retailers, and retail sales carry taxes totaling 13%. Adult-use cannabis products are exempt from ordinary sales tax. Many licensed stores deliver, and the MRTA created separate licenses for delivery and on-site consumption lounges. Adults must still keep cannabis away from minors, never drive impaired and not carry it across state lines, including to New Jersey. This page is general information, not legal advice.
