How cannabis is sold in Maine

Yes: adults 21 and older can buy, possess and grow cannabis in Maine. Voters approved legalization in November 2016, and licensed adult-use stores began selling on October 9, 2020. The Office of Cannabis Policy (OCP), part of the Department of Administrative and Financial Services, licenses adult-use businesses and also runs the medical program, which is served by dispensaries and registered caregivers.

Under Title 28-B of Maine law, an adult may possess, carry or give away without payment up to 2.5 ounces of cannabis, of which no more than 10 grams may be concentrate, and a store may not sell more than that in a single transaction. Home growers may keep 6 mature plants, 12 immature plants and an unlimited number of seedlings, and may buy up to 12 immature plants or seedlings from licensed stores. Consumption is limited to a private residence or private property where the owner allows it. Smoking is banned in public places and wherever tobacco smoking is banned, and nobody may use cannabis while driving or riding in a vehicle on a public road. Stores may offer curbside pickup and a limited delivery service after checking ID, and towns cannot ban that delivery.

The price at the counter rose on January 1, 2026, when the sales tax on adult-use cannabis went from 10% to 14%, according to Maine Revenue Services. Two other 2026 developments are worth knowing. A citizen initiative to end the adult-use market while keeping medical cannabis did not file signatures by the February 2, 2026 deadline, so the earliest it could reach voters is November 2027. LD 1847, a bill to require adult-use-style testing and inventory tracking for medical cannabis, died when the Legislature adjourned.
