What did the ruling leave standing?

The court held the 1,000-foot school buffer is pre-empted by the state's 500 feet, but left the 1,000-foot residential setback and the commercial-corridor rules in place. A new suit, filed on 5 August 2026 by 1086 OCR LLC and Brian Stark Enterprises, targets the town's 2,500-foot spacing rule, which the Appellate Division called academic after upholding the Ostrander denial.
