What will you pay at a Santa Fe register?

Roughly 21%, because two taxes apply to the sale. The New Mexico Taxation and Revenue Department sets the excise schedule, and the gross receipts rate depends on the exact location.

Year from July 1State cannabis excisePlus Santa Fe GRT
202513%8.1875%

Stores outside city limits in Santa Fe County charge a different gross receipts rate, so the same product can ring up slightly differently a few miles out.

How to pick among 60 licensed stores

Sixty licenses is a lot for a city this size, and no Santa Fe store has a full Verdex profile yet, so the register listing is the starting point. Match the store name to its license on the New Mexico Cannabis Control Division records, check that products carry state-required labels, and ask for an itemized receipt showing both taxes. The first-visit guide covers ID and payment, and every listed store is on the New Mexico hub.

Rules visitors miss around Santa Fe

Several Pueblo nations sit within a short drive of the city, and tribal land follows tribal law, not state cannabis law. National forest and Bandelier or other federal land falls under federal law, where possession stays illegal. Smoking in public, including the Plaza, is not allowed; licensed consumption areas are the legal alternative. Carry products sealed in a vehicle, and do not cross into Colorado or Texas with them. If in doubt, run our cannabis use check. Sellers with regulator actions show up on the Red List.

Altitude is worth a mention for first-time visitors: Santa Fe sits around 7,000 feet, and many people feel alcohol and fatigue more strongly here. Staff at licensed stores are used to that question, so start with a lower dose and ask what the THC per serving is before buying edibles. Keep the receipt; it proves the purchase came from a licensed store if you are ever asked.

Cannabis in Santa Fe: questions

Do I need a medical card to buy cannabis in Santa Fe?

No. Adult-use sales have been legal in New Mexico since April 1, 2022, and anyone 21+ with valid photo ID can buy. Medical patients still get tax advantages at medical counters.

What is the cannabis tax in Santa Fe in 2026?

The state cannabis excise rose to 14% on July 1, 2026, and the City of Santa Fe gross receipts tax of 8.1875% applies too. The excise is scheduled to rise by one point each July until it reaches 18% in 2030.

Can I bring cannabis onto Pueblo land near Santa Fe?

Not unless that nation's law allows it. Tribal land is governed by tribal law, and New Mexico's cannabis law does not protect you there.

Where can I legally use cannabis in Santa Fe?

At a private residence where the owner allows it, or at a state-licensed cannabis consumption area. Public places such as the Plaza and parks are off-limits.
