How it works

How cannabis is sold in Silver City

The newest change that reaches Silver City is a statewide one: the cannabis excise tax stepped up to 14 percent on July 1, 2026, per the state hub. Locally the rulebook has not moved since the Town Council passed Ordinance 1316 on March 14, 2023.

What Ordinance 1316 actually does

An integrated cannabis microbusiness is allowed outright in the Commercial-Historic district, the town's downtown, and in the Light Commercial, Highway Commercial and Industrial districts; in Mixed-Use it needs a conditional use permit. Class IV manufacturing is confined to industrial land. Grant County Beat reported the 300-foot boundaries are measured property line to property line, which matters for tight downtown lots.

Not as few options as the map suggests

A town of about 9,700 people (2020 census) has 14 register entries. The downtown cluster is on North Hudson and North Pope streets: Big Ranch Cultivation - Hudson Retail at 909 N Hudson, Buffalo Bud Farming CO LLC - Retail at 910 N Pope and Fci Of New Mexico - N Pope St Retail at 1001 N Pope. Out on US 180 sit Boa Holistic LLC - Retail, and the Silver Heights Boulevard pair, Fly High Cannabis LLC - Silver Heights Retail and Happy Herb LLC. Big Ranch at 909 N Hudson appears twice in the register, so count it once.
