Who shops in Las Cruces, and why it matters

A big share of Las Cruces customers drive up from El Paso and other parts of Texas, where adult-use cannabis is illegal. That is why so many stores line Interstate 10 exits and the roads toward the state line, and why the city has 113 licensed locations for a population near 115,000. Buying in New Mexico is legal for any adult 21+. Carrying the product back is not.

Border Patrol checkpoints: the rule visitors miss

U.S. Border Patrol runs permanent checkpoints on highways leaving the Las Cruces area. Agents enforce federal law, under which cannabis is still illegal, so a legal New Mexico purchase can still be seized there. Crossing into Texas adds state charges. Plan to use what you buy in New Mexico, on private property. Travelers heading west toward Deming or north toward Hatch and Truth or Consequences should expect to pass a checkpoint on the interstate, and agents can refer a vehicle to secondary inspection. Rental cars and rideshares get no exemption.

Local visitors from Juárez face a similar problem in reverse: bringing cannabis across an international port of entry is a federal offense, and Mexican authorities treat it as a crime as well.

What the receipt looks like

The 14% excise tax is set by the state and rises one point each July until it hits 18% in 2030. Gross receipts tax depends on the store's address; the TRD schedule puts Las Cruces around 8.39%. There is no separate city cannabis tax. More on statewide rules is on the New Mexico hub, and the cannabis use check tool is a quick self-check before buying. We have flagged stores that misuse licenses on the Red List.
