A zoning fight, not a ban

Mayor Dennis Kintigh said openly that he had reservations about the industry. What the city could actually do was zone: New Mexico's Cannabis Regulation Act leaves municipalities that tool but no prohibition, so Roswell's argument played out case by case. The Roswell Daily Record describes a Commercial Cannabis district, CCAN, carved out of the C-2 community commercial zone, and applicants who sat inside a buffer had to ask the council for a variance. I found no moratorium in the sources I could open.

Sixteen licences, one main road

Verdex lists 16 dispensaries with a Roswell address. In the register, five of the eight we hold in detail sit on North Main Street between 2303 and 3606, among them Accendo INC - N Main St Retail, Animacann INC - Main St - Retailer and Gnomad LLC - 3606 N Main Retail. The exceptions are 285 South Dispensary LLC - Main St. Retail at 1725 SE Main, Compassionate Distributors INC - Walnut Retail on West Walnut and Occ Abq LLC on West 2nd. None is on the downtown blocks the draft protected.

The 2021 draft ordinance excluded the Downtown Historic District and the Railroad Metropolitan Redevelopment Area, as KOB reported. Check the city's current zoning map before trusting an address, because variances were granted case by case.

Did Roswell ever ban recreational sales?

No ban is on record in the sources I could open. State law lets cities zone cannabis businesses but not prohibit them, and the council approved its first recreational operators in 2022 by 7 to 2 votes.
