City or county: why the address changes the tax
The City of St. Louis and St. Louis County are separate governments, and both asked voters for a 3% marijuana tax in April 2023. More than 60% of city voters said yes; county voters approved theirs with 65%, and suburbs such as Maryland Heights, Hazelwood, Berkeley and Kirkwood passed their own.
That set up a fight over stacking. A Florissant dispensary challenged paying both a city and a county 3%, and a circuit judge first sided with the county in 2024.
Which 3% applies where?
Only one local marijuana tax applies per sale now, and it depends on the store's address, not where you live.

On top of any local 3%, every adult-use sale in Missouri carries the 6% state tax plus ordinary state and local sales tax, according to the Division of Cannabis Regulation. Rates in suburbs differ, so a store a few miles apart can ring up differently.

What is the marijuana tax in St. Louis City?
Missouri charges 6% on adult-use sales, plus general state and local sales tax. On top of that, St. Louis City voters approved a 3% local marijuana tax in April 2023, with more than 60% in favor.
Can St. Louis County also tax a store inside a city?
No. In July 2025 the Missouri Supreme Court ruled 6–1 that under Article XIV a county may levy its marijuana tax only in unincorporated areas. Inside an incorporated city, only that city's tax applies.
How much can I buy at a St. Louis dispensary?
Adults 21 and over may buy up to 3 ounces of dried marijuana or its equivalent in a single transaction and possess up to 3 ounces at one time. A valid government-issued photo ID is required.
Can I smoke in the dispensary parking lot?
No. The Division of Cannabis Regulation states that public consumption is not allowed and that consuming on the premises of a licensed dispensary, including in approved transport vehicles, is strictly prohibited.
