How cannabis is sold in Fort Lauderdale

Four dates explain how Fort Lauderdale's medical-only market works, and one of them is the city defying the state.

  1. Florida voters approve Amendment 2, legalising medical marijuana.

  2. The city says it will enforce a cap of one dispensary per commission district although state law tells cities to treat dispensaries like pharmacies. Four operators had applied in the Northeast district, WLRN reported, and three were to be refused.

  3. Governor DeSantis signs the bill ending the ban on smokable medical marijuana.

  4. The Secretary of State finds the adult-use initiative 96,460 signatures short of the 880,062 needed, and the Florida Supreme Court later declines a rehearing.

Does the one-per-district rule still stand?

The city's land-development code, section 47-18.46, treats a dispensing facility as a conditional use in the B-1, B-2 and B-3 business zones, with one facility per 40,000 residents and one per City Commission District. WLRN reported a 1,500-foot buffer from parks and schools, and the code text adds libraries and child day care. The 2018 story noted that no applicant had yet sued. We found no later court ruling or repeal, so read the cap as the city's position, not settled law.
