What changed for Columbus buyers in 2026?

Senate Bill 56 rewrote parts of the 2023 voter-approved law, and most of it took effect on March 20, 2026, according to Ohio State's Moritz College of Law and Tyack Law Firm.

  1. Columbus City Attorney Zach Klein stops prosecuting misdemeanor marijuana possession, citing hemp testing limits.

  2. Ohio voters approve Issue 2, legalizing adult use.

  3. Ohio dispensaries start adult-use sales under dual-use certificates.

  4. SB 56 takes effect: out-of-state cannabis banned, open products go in the trunk, intoxicating hemp removed from sale.

The practical changes are easy to miss. Anything bought in Michigan or elsewhere is no longer legal to hold in Ohio. Potency caps also dropped to 35% THC for plant material and 70% for extracts, so some products seen before 2026 no longer appear on shelves.

Only on private residential or agricultural property. Smoking or vaping in public can bring a fine of up to $150, and a passenger using cannabis while the driver operates the vehicle can face a third-degree misdemeanor.

Can Columbus smoke shops still sell delta-8 or other hemp THC?
