Possession (no prescription)
Illegal in all states and the Northern Territory; penalties and diversion schemes vary by state. The ACT allows adults limited personal possession (see below).
Prescribed cannabis
Legal when prescribed by a doctor through the TGA Special Access Scheme or Authorised Prescriber pathway and dispensed by a pharmacy. Only Epidyolex and Sativex are registered medicines.
ACT personal use
Since January 31, 2020 adults 18+ in the ACT may possess up to 50 g dried (150 g fresh) and grow 2 plants per person, 4 per household. Sale, supply and public use remain offenses; Commonwealth law is unchanged.
Home grow
Illegal everywhere except the limited ACT allowance; a prescription does not permit cultivation. Commercial cultivation requires Office of Drug Control licences.
Public use
Illegal. Even in the ACT, using cannabis in public or near anyone under 18 is an offense.
Driving
Roadside tests detect THC regardless of prescription. Tasmania has a medical defence since 2017; Victoria's magistrates have had licence-loss discretion for some patients since March 2025; NSW passed a registration-based reform on September 17, 2026, not yet in force.
Advertising
Advertising prescription medicines, including medicinal cannabis, to the public is prohibited under the Therapeutic Goods Act; the TGA issues fines and brings court cases.
CBD products
Low-dose CBD (up to 150 mg a day, adults) was down-scheduled to pharmacist-only in 2021, but no product had been approved for that route by 2026; other CBD requires a prescription.
Age
No statutory minimum for prescriptions, but Medical Board guidance (July 2025) says doctors should avoid prescribing to patients under 18; most clinics accept adults only. ACT personal-use rules apply to 18+.

How cannabis is sold in Queensland
Queensland follows the national prescription model: a doctor applies through the TGA pathways, and a pharmacist dispenses under Queensland's medicines laws, with Queensland Health publishing state-specific guidance for prescribers and pharmacists. Possessing or growing cannabis without a prescription remains illegal, and roadside drug tests do not distinguish prescribed THC.
Brisbane has several in-person options alongside telehealth. Releaf, which says it was established in 2017, runs a clinic with an on-site dispensary on Brunswick Street in Fortitude Valley and another in Caloundra on the Sunshine Coast, open on Saturday mornings. Naturaleaf Clinic's GPs also consult at a practice on Ipswich Road in Annerley. The Gold Coast is home to Burleigh Heads Cannabis, one of the first licensed importers and wholesalers of medicinal cannabis, which supplies pharmacies through its Canview platform rather than selling to patients.
Queensland residents can also use national telehealth clinics and have scripts posted by dispensaries elsewhere. Check what a clinic charges for follow-ups and whether its dispensary sells at recommended retail price before committing.
