  • Possession

    Criminal offense above 0.3% THC (§27 SMG): up to 1 year, 6 months for personal use; personal cases are usually diverted with 1–2 years' probation (§35 SMG).

  • Home grow

    Growing cannabis to obtain narcotics is punishable (§27(1) No. 2 SMG); seeds and cuttings are legal to buy.

  • Sales

    Selling THC cannabis is illegal; commercial dealing up to 3 years (§27(3) SMG).

  • CBD flowers

    Legal up to 0.3% THC; tobacco-monopoly goods sold by Trafiken and, until 31 Dec 2028, MVG-licensed hemp shops. No online sales.

  • CBD oils and food

    Unauthorized novel food; may not be sold as food or supplements (AGES).

  • Medical

    Dronabinol, approved extract medicines (e.g. Sativex) and Epidyolex on prescription; no cannabis flower (§14 Narcotics Ordinance).

  • Public use

    Handing over or selling in public places or transport carries up to 2 years (§27(2a) SMG).

  • Driving

    No legal THC limit; €800–3,700 fine and at least one month's licence withdrawal, three months after an accident (ÖAMTC).

How cannabis is sold in Vienna

The date that reshaped Vienna's CBD trade is 21 November 2024, when the Administrative Court ruled that smokable hemp is a monopoly good.

  1. The court decides that hemp flower of up to 0.3 percent THC falls under the tobacco tax and monopoly acts.

  2. Cut-off date: only hemp specialists trading mainly in flowers that day can apply to keep selling.

  3. The Nationalrat passes the Abgabenänderungsgesetz 2025, writing hemp flower into the monopoly and allowing licensed shops to sell to the end of 2028.

  4. The MVG opens licence applications.

  5. The MVG list of licensed hemp shops carries this date.

Which districts have a listed shop?

CBD BRO has two: Porzellangasse 8/6 in the 9th district and Nisselgasse in the 14th. Hanf Mann has three, in Hernals (Hernalser Hauptstraße 79A/6), Margareten and Brigittenau. Cannabis Store Vienna is at Matzleinsdorfer Platz 3 in the 5th, Hanf Residence at Wilhelmstraße 58/1B in Meidling, Magu CBD at Esterházygasse 34 in the 6th and supHerb in Praterstraße and Kettenbrückengasse. Each profile covers a business with several shops; the MVG licence is per business, so confirm the branch you visit.

Is Vienna more lenient than the rest of Austria?

No. The Suchtmittelgesetz applies nationwide, and the licence list, not the city, decides who may sell flower.
