What sort of shop qualifies?
The MVG licence was open only to specialist hemp shops that took most of their revenue from flowers holding no more than 0.3 percent THC on 10 January 2025. The applicant needs full business capacity, a valid trade licence and no serious convictions, and must buy from the approved wholesale.
Bavaria is next door, so does German law help?
Not on the Austrian side. Germany's Konsumcannabisgesetz permits adults to carry limited amounts at home, but I found no exception in the Suchtmittelgesetz for cannabis bought there, and section 27 punishes possession of any THC cannabis. Prosecutors may divert personal-use cases under section 35. Germany's evaluation of its law runs to April 2028, so its limits can still move. Austria's overview is on the national page.
