Plain-language summary. The regulator is Healthcare Improvement Scotland.

  • Possession (no prescription)

    Illegal. Cannabis is Class B, with a maximum of five years' imprisonment and/or an unlimited fine; for possession, police may instead give a warning or a penalty notice of up to £90 on the spot.

  • Prescribed cannabis

    Legal when prescribed by a doctor on the GMC Specialist Register and dispensed by a registered pharmacy.

  • Home grow

    Illegal. Growing counts as production of a Class B drug, with a maximum of 14 years in prison; a prescription does not permit cultivation.

  • Public use

    Using non-prescribed cannabis anywhere is illegal, and prescribed cannabis-based products must not be smoked.

  • Driving

    Driving while impaired is illegal everywhere in the UK. England, Scotland and Wales also have drug limits (THC: 2 µg per litre of blood in England and Wales); the limit offense does not apply to drugs taken as prescribed if you are fit to drive. Minimum penalty: a one-year ban.

  • CBD products

    Allowed as food only if linked to an application on the FSA public list (England and Wales) and if controlled cannabinoids such as THC stay within 1 mg per container.

  • Daily CBD intake

    FSA advice: healthy adults should have no more than 10 mg of CBD a day from food; the THC safe upper limit is about 70 µg a day for an adult (July 2025).

  • Age

    No statutory minimum age for a specialist prescription (NHS use includes children with rare epilepsies), but the private clinics in our directory take adults only (18+, or 21+ at Integro). The FSA advises under-18s not to take CBD.

How cannabis is sold in Scotland

The 2018 regulations that moved cannabis-based medicines into Schedule 2 were made for England, Wales and Scotland together, so the position in Scotland is the same: a doctor on the GMC Specialist Register can prescribe, and non-prescribed cannabis remains a Class B drug. Independent healthcare services in Scotland, including clinics and independent medical agencies, are regulated by Healthcare Improvement Scotland, which keeps its own searchable register.

In practice many Scottish patients use online clinics registered in England. Several services in our directory, such as Curaleaf Clinic, say they accept patients from Scotland, and pharmacies such as Lyphe Dispensary say they dispatch there. Deliveries to remote areas can take longer; one CBD retailer quotes four to six working days for the Highlands and Islands.

CBD rules differ in one respect: novel foods in Scotland, including CBD, are the responsibility of Food Standards Scotland rather than the FSA, although the two agencies have updated their consumer advice together. The drug-driving law with specified drug limits also applies in Scotland, as it does in England and Wales.
