Is Weed Legal in Idaho? Penalties, HJR 4 and the Zero-THC CBD Rule

Marijuana is illegal in Idaho, with a $300 mandatory minimum fine. Voters decide HJR 4 in November 2026, and CBD must be THC-free.

Key takeaways

  • Marijuana is illegal for all uses; 3 oz or less is a misdemeanor with a $300 mandatory minimum fine for adults.
  • More than 3 oz (under 1 lb) is a felony with up to 5 years.
  • HJR 4 on the November 3, 2026 ballot would give only the Legislature the power to legalize marijuana.
  • Consumer CBD must have no detectable THC; delta-8 is illegal.

Fifty miles from Boise, a store sells cannabis legally. On the Idaho side of the Snake River, the same bag is a crime, and the state keeps writing its laws to make sure it stays that way.

What a possession charge costs in Idaho

AmountChargeMaximum penalty
3 oz or lessMisdemeanorUp to 1 year in jail and a $1,000 fine; $300 mandatory minimum fine for adults 18+
More than 3 oz, less than 1 lbFelonyUp to 5 years in prison and a $10,000 fine

The mandatory minimum came from a 2025 bill sponsored by Representative Bruce Skaug that Governor Brad Little signed, according to the Idaho Capital Sun. NORML's summary of Idaho Code 37-2732 gives the amounts above. The fine applies to adults regardless of whether a judge would otherwise have chosen a lower one.

What is on the November 2026 ballot

MeasureStatusWhat it does
HJR 4On the ballot, November 3, 2026Yes: only the Idaho Legislature may legalize marijuana, narcotics or other psychoactive substances, and citizen initiatives on them end. No: initiatives remain possible
Idaho Medical Cannabis ActDid not qualifyThe Secretary of State said on July 14, 2026 that it missed signature count and district distribution requirements
Decriminalize Cannabis NowDid not qualifyNot on the ballot

HJR 4 passed the House 58 to 10 on March 5 and the Senate 29 to 6 on March 11, and it requires no signature from the governor because constitutional amendments go straight to voters. Supporters of the medical initiative had claimed more than 150,000 signatures, but valid signatures also had to come from enough legislative districts.

CBD in Idaho must have no detectable THC

Idaho defines industrial hemp at the federal 0.3 percent delta-9 limit for the plant, but its Office of Drug Policy says consumer CBD is legal only if it contains no detectable THC. Idaho Code 37-2705 lists any preparation containing tetrahydrocannabinols as Schedule I, so a full-spectrum oil that is legal in Oregon can be an illegal drug in Idaho. Delta-8 is illegal.

  • Isolate or verified THC-free — the certificate of analysis should show no detectable THC, not just "under 0.3%"
  • Shipments in transit — Idaho State Police and local officers have seized hemp shipments passing through, according to compliance summaries
  • Delta-8, THCA and delta-9 gummies — illegal in Idaho even when they are legal where they were bought

The same THC-free rule is why hemp shoppers in Boise drive to Oregon: our Ontario, Oregon border guide explains what a buyer faces on the way back. Neighbors differ widely: read the Montana guide and the Oregon hub, and see how delta-8 and hemp THC rules are changing federally. The Idaho hub keeps the state summary.

FAQ

Is weed legal in Idaho in 2026?

No. Marijuana is illegal for recreational and medical use. A medical cannabis initiative failed to qualify for the 2026 ballot after the Secretary of State said on July 14 that it missed signature requirements.

What is the penalty for possessing marijuana in Idaho?

Three ounces or less is a misdemeanor with up to a year in jail, a fine up to $1,000 and a $300 mandatory minimum fine for adults. More than three ounces but under a pound is a felony with up to five years and a $10,000 fine.

Is CBD legal in Idaho?

Only if it contains no detectable THC, according to the Idaho Office of Drug Policy. Idaho's Schedule I definition covers any preparation containing THC, so many CBD products legal in other states are not legal in Idaho.

What does Idaho HJR 4 do?

It would amend the constitution to give only the Idaho Legislature the power to legalize marijuana, narcotics or other psychoactive substances and end citizen initiatives on those subjects. It passed the House 58-10 and the Senate 29-6 and appears on the November 3, 2026 ballot.

Is delta-8 legal in Idaho?

No. Delta-8 is illegal in Idaho, and even hemp-derived THC products are controlled substances under state law unless they contain no detectable THC.
