CBD Oil in Italian Pharmacies: What Is Legal in 2026
A Health Ministry decree would make oral CBD prescription-only. It is suspended and now sits with the EU Court of Justice. What a pharmacy can legally give you meanwhile.
This guide is about Italy — not the country you picked in the header.

Key takeaways
- A pharmacy can dispense CBD as a medicine: Epidyolex, or a preparation compounded on a doctor's prescription.
- The 27 June 2024 decree making oral CBD prescription-only is suspended; the Council of State referred it to the EU Court of Justice on 3 August 2026.
- CBD is not authorised in food or supplements in Italy, and flower-derived oils have been banned from trade since April 2025 according to the pharmacists' federation.
- EMA lists sleepiness, reduced appetite, diarrhoea and raised liver enzymes for the licensed CBD medicine.
- EFSA (February 2026) cannot establish CBD safety for under-25s, pregnancy, breastfeeding or people on medication.
On 3 August 2026 the Council of State stopped deciding whether Italy could put oral CBD on the medicines table and asked Luxembourg instead. On 14 August the Lazio regional court, in two separate cases, rejected two more company appeals, one against the decree and one against the ministry's circular on cosmetics. The sector's own reading is that nothing has changed on the shelf. The pharmacists' federation reads the situation differently on flower-derived oils.
So what does an Italian pharmacy really sell under the name “olio CBD” in September 2026, and what should the label tell you? This guide sorts it. It is general information, not medical or legal advice.
Where does the 2024 decree stand, one court at a time?
| Step | What happened | Effect on pharmacies |
|---|---|---|
| Ministry decree, 27 June 2024 | Oral compositions of CBD from cannabis extracts placed in Section B of the medicines table of DPR 309/1990; in force 5 August 2024 | Non-repeatable prescription; purchase vouchers and narcotics register |
| Circular, 7 August 2024 | Operational rules for doctors, vets and pharmacists; synthetic CBD excluded; CBD barred from food at any concentration | Register page for CBD and each preparation |
| Regional court of Lazio | Suspended the decree on an interim basis in 2024; upheld it in 2025 (ruling 7513/2025) | Back and forth |
| Council of State, December 2025 | Suspended the effect of the 2025 ruling upholding the decree (order 9053/2025) | Vouchers and register entries suspended; earlier rules apply |
| Council of State, 3 August 2026 | Three appeals paused, questions sent to the EU Court of Justice | Decree stays suspended pending the answer |
| Regional court of Lazio, 14 August 2026 | Rejected two more company appeals (Cbweed, against the decree; Crystal, against the circular's cosmetics section) | No new obligation |
The 14 August rulings led to headlines that CBD needs a prescription. Canapa Sativa Italia, a network of more than 400 hemp companies, told ANSA on 17 August that this is wrong: the suspension stands, and the Health Ministry has said the pharmacy control measures lapse while the decree is suspended. Farmacista33, the trade press, reported the same instruction to pharmacists after the December order: stop the vouchers, follow the pre-2024 regime.
What can a pharmacy legally give you today?
| Product | Legal route | Who may get it |
|---|---|---|
| Epidyolex (cannabidiol 100 mg/ml) | EMA-authorised, prescription only; AIFA reimbursement for Lennox-Gastaut and Dravet syndromes since a determination published in Gazzetta Ufficiale no. 149 of 24 June 2021 | Patients aged 2 and over with Lennox-Gastaut or Dravet syndrome (with clobazam) or tuberous sclerosis, prescribed by hospital specialists |
| Compounded CBD preparation | Made by the pharmacist on a doctor's prescription; synthetic CBD sits outside the narcotics law, pharmaceutical-grade extract goes on the narcotics register | A patient with a prescription |
| Hemp seed oil, cosmetics | Ordinary retail; seed-derived food and cosmetics are not covered by the flower ban | Anyone |
| Oil extracted from hemp flowers | Trade banned since April 2025 by art. 18 of Decree-Law 48/2025, per the pharmacists' federation FOFI | No lawful over-the-counter route |
| CBD “integratore” (supplement) | The 2024 circular says CBD cannot be used in any category of food; EU novel-food rules apply | Not authorised |
Two lessons follow. First, a bottle marked “CBD” sitting next to vitamins is not proof of anything. FOFI's line is that flower-derived oils and extracts can no longer be sold, and the circular puts CBD supplements outside food law. Second, the pharmacy is the only place where CBD is made to a documented standard, and it comes with a prescriber attached. The wider legal fight over flower is in our cannabis light explainer, and the court referral in the Council of State news item.
What do EMA, the ISS and EFSA say about side effects?
Italy's health institute (ISS) and the Higher Health Council issued updated opinions in May and June 2024. According to Farmacista33's summary, they stress that natural CBD is never entirely free of THC, that it can interact with other medicines, and that pharmacovigilance systems have flagged contamination with synthetic cannabinoids. Those opinions are the base for the ministry's caution. They do not, on that account, prove a psychoactive effect from CBD, which was the point the trade groups contested.
For hard numbers on a regulated product, look at the licensed medicine. EMA's public page for Epidyolex lists somnolence, decreased appetite, diarrhoea, fever, tiredness and vomiting as the most common effects, and raised liver enzymes as the commonest reason to stop treatment. It must not be used when liver enzymes are more than three times the normal limit with bilirubin above twice the limit. Treatment is started and supervised by a doctor experienced in epilepsy.
How to ask for it, and what to check
- A prescription with the substance named. A compounded preparation needs the doctor to write it and the pharmacist to accept it; ask before you go.
- The medicine's name and leaflet. Epidyolex comes with an official package leaflet; ask the pharmacy what a compounded product contains and who prepared it.
- No therapeutic promise. A retail oil that claims to treat a condition is behaving like an unlicensed medicine.
- The source of the CBD. Seed-derived, synthetic or flower-derived matters legally: only the first two sit outside Article 18.
- A lab certificate. Ask for the batch analysis with THC content; our COA guide shows the lines that matter.
FAQ
Can I buy CBD oil in an Italian pharmacy without a prescription?
Prescription medicines such as Epidyolex need one. For other CBD oils the picture is unclear: the 2024 decree that would have made oral CBD prescription-only is suspended, but flower-derived oils are banned from trade by Decree-Law 48/2025 according to the pharmacists' federation. Ask the pharmacist what the product is made from.
Is the Ministry of Health decree on CBD in force?
Its effect is suspended. The Council of State suspended it in December 2025 and on 3 August 2026 referred questions to the EU Court of Justice. Canapa Sativa Italia said on 17 August 2026 that it remains suspended until that court decides.
What is Epidyolex and who gets it?
An authorised cannabidiol solution. EMA lists it with clobazam for Lennox-Gastaut and Dravet syndromes from age 2, and with other epilepsy treatments for tuberous sclerosis complex. It requires a prescription and specialist supervision.
What are the contraindications of CBD oil?
For the licensed medicine EMA lists sleepiness, reduced appetite, diarrhoea and raised liver enzymes, and bars use with severely raised liver markers. EFSA cannot establish safety for under-25s, pregnancy, breastfeeding or people on medication.
Is CBD legal as a food supplement in Italy?
No. The Ministry of Health's circular of 7 August 2024 says CBD, extracted or synthetic, cannot be used in any food category because it is a novel food under EU Regulation 2015/2283, and no CBD food has EU authorisation.
Is synthetic CBD treated differently?
Yes for the narcotics law. The circular says the 2024 decree does not apply to CBD produced only by chemical synthesis, so it falls outside DPR 309/1990, but the food and medicine rules still apply.
