On tax, the Federal Supreme Court ruled on January 29, 2020 that low-THC flowers are not a tobacco substitute, ending a 25% levy. The customs guide of March 2026 still lists cigarettes "also without tobacco" as taxable at 11.832 centimes a stick plus 25% of the retail price, which could reach ready-made hemp cigarettes.

The border is the trap: Germany and Austria draw the line at 0.3% THC, so a Swiss flower at 0.8% is legal in Basel and can count as cannabis in Lörrach. Read the Swiss CBD rules and Germany's CBD flower status before you cross.

Is CBD oil legal in Switzerland?

CBD oil may not be sold as food or a food supplement, because the Federal Food Safety and Veterinary Office treats CBD as a novel food and has authorized none. Shops sell it as aroma oil or cosmetic, and any product with 1.0% THC or more is a narcotic.

How old must you be to buy CBD flower in Switzerland?

18. Smokable hemp products fall under the Tobacco Products Act, in force since October 1, 2024, which bans sales to minors, according to the Federal Office of Public Health.

Can I bring Swiss CBD flower into Germany or Austria?

Not safely. Both countries use a 0.3% THC line, so Swiss flower with up to 1% THC can count as cannabis there. The destination's limit applies, not the Swiss one.
