On July 9, 2026 the Verden Regional Court ruled that police had wrongly seized hemp flowers declared as THC-free, because a merely theoretical possibility of misuse does not justify a criminal suspicion (case 1 Qs 12/26, as reported by trade press). The decision is the latest sign that German courts are rethinking the "intoxication clause" that has hung over CBD shops for years. It has not made that clause disappear.
The two tests a hemp flower must pass
Nutzhanf (industrial hemp)
Under §1 No. 9 KCanG, plants and flowers count as industrial hemp when their trade, apart from cultivation, serves only commercial or scientific purposes that rule out abuse for intoxication, and they come from certified EU hemp varieties or contain no more than 0.3% THC.
Anything that fails the definition is simply "cannabis" under the KCanG. Adults may possess and grow that within the personal limits, but selling it is illegal trade (§34). This is why a shop selling CBD flowers carries criminal risk that a customer holding a few grams does not.

What the courts have said since the Cannabis Act
Before April 2024, the Federal Court of Justice (BGH) took a strict line. In a 2022 decision (5 StR 490/21), as summarized by Krautinvest, it accepted that intoxicating misuse of hemp flowers was possible, for example when THC is released by heating in baking, and treated that possibility as enough. Lower courts are now weighing the changed legal situation differently.

These are individual decisions, not binding on other courts, and none is from the BGH under the new law. A draft Industrial Hemp Liberalization Act (Nutzhanf-Liberalisierungsgesetz), which would have removed the clause, lapsed with the previous coalition; the Greens reintroduced it in October 2025, Krautinvest reported in April 2026. It has not been passed.

Buying CBD flowers: a checklist
- Batch certificate — a recent lab report showing total THC at or below 0.3% for the batch you buy, not a generic sample.
- Variety and origin — the seller should name the certified EU hemp variety or the lab basis for the 0.3% claim.
- Honest labeling — flowers marketed as "strong", "like the real thing" or for getting high undercut the seller's own defense.
- A real business — an imprint (Impressum) with a German or EU address; Watchlist Internet has listed fake CBD shops aimed at German buyers.
- Your limits — if a product tests above 0.3%, it is cannabis: the 25 g public limit then applies to you.
