Cannactiva, Verdex's only Spanish CBD seller so far, has shops in Barcelona (Plaça d'Osca 6) and Madrid and an online store selling hemp flowers, hash, oils and cosmetics under 0.2% THC. The flowers and hash are the part of that range the Supreme Court addressed on April 23, 2026 in ruling STS 301/2026, which treated hemp flower with 0.3% to 0.7% THC as a narcotic under the trafficking article of the Penal Code. Oils sold as cosmetics are not directly affected, but CBD foods and supplements were already unauthorized under EU rules.

Spanish law defines cannabis by plant part: flowering tops are controlled whatever the THC, according to the Plan Nacional sobre Drogas. In the ruling the court used criteria from the National Institute of Toxicology and Forensic Sciences, and Soft Secrets' legal analysis reads it as treating about 10 mg of THC per consumer-ready unit as relevant, which a few grams of 0.3% flower already exceed. More than 30 companies have joined a collective defence, with a clarification motion filed and a constitutional appeal being prepared; nothing has changed yet.
A cautious buyer looks for a lab certificate with total THC and a matching batch number, no health claims, and no HHC or THCP vapes. "Not for consumption" labels on flowers do not settle the legal question. See CBD in Spain and the news report on the ruling.

Is it legal to buy CBD flower in Spain?

Can CBD oil be sold in Spain?
Yes, mostly as a cosmetic. CBD may not be sold as a food or supplement because the EU has not authorized it as a novel food, according to Spain's medicines agency AEMPS and EU food rules.
Are HHC and THCP legal in Spain?
No. HHC, HHC-O, THCP, THC-O and related semi-synthetics have been controlled psychotropics since April 23, 2025 under Order SND/380/2025, according to the Health Ministry.
