Possession
Adults may possess cannabis in private for personal use (Prince, 2018). The 2024 Act is not yet in force; February 2026 draft regulations proposed 750 g in a private place.

Private cultivation for personal use is protected; draft regulations (Feb 2026) proposed up to five plants.
Public use
Not protected; smoking or selling cannabis in public remains an offence.
Sales

Schedule 4, except complementary medicines with ≤600 mg per pack and ≤20 mg daily dose making low-risk claims (Schedule 0).

Driving under the influence of a drug with narcotic effect is prohibited (National Road Traffic Act s65); the 2024 Act adds THC explicitly once in force.

The Western Cape has one of the densest clusters of SAHPRA-licensed cultivators in the country, from Biotic Pharm (formerly Cannsun) near Atlantis to Karoo Green in the Klein Karoo, which also runs a doctor-led Section 21 route for patients. Cape Town is also a centre for legal CBD and hemp retail, with long-running businesses such as Hemporium in Westlake and CBD brands such as RethinkCBD in Paarl, plus grow-equipment suppliers that ship nationwide.
The province is also where the limits of the law have been tested. The Haze Club case in the Western Cape High Court concerned private cannabis clubs, and it did not produce a clear ruling that makes them legal; the appeal was withdrawn. Clubs, delivery services and shop-front dispensaries selling THC therefore remain unlawful to buy from, however openly they trade.
Adults may still grow and use cannabis in private, and medical patients can obtain products with a Section 21 authorization. Low-dose CBD is sold in pharmacies and health shops within SAHPRA's Schedule 0 limits.
