The rules

Key rules in South Africa

Plain-language summary. The regulator is SAHPRA.

  • Possession

    Adults may possess cannabis in private for personal use (Prince, 2018). The 2024 Act is not yet in force; February 2026 draft regulations proposed 750 g in a private place.

  • Home grow

    Private cultivation for personal use is protected; draft regulations (Feb 2026) proposed up to five plants.

  • Public use

    Not protected; smoking or selling cannabis in public remains an offence.

  • Sales

    Any sale of cannabis outside SAHPRA-licensed medical channels is a criminal offence; private clubs are in a grey zone.

  • CBD

    Schedule 4, except complementary medicines with ≤600 mg per pack and ≤20 mg daily dose making low-risk claims (Schedule 0).

  • Driving

    Driving under the influence of a drug with narcotic effect is prohibited (National Road Traffic Act s65); the 2024 Act adds THC explicitly once in force.

How cannabis is sold in Cape Town

A visitor in Cape Town who hears of a members' "grow club" near Long Street should know how the courts treated one: on 29 August 2022 Judge Slingers of the Western Cape High Court held that the Haze Club's model amounted to dealing.

  1. Start with CBD in a pharmacy
    Clicks sells over-the-counter CBD oils and capsules within SAHPRA's 20 mg daily-dose limit, in store and online.
  2. Try hemp and cosmetics
    Hemporium, founded in 1996, has a concept store at Westlake Business Park, 15 Bell Crescent, and sells hemp textiles, cosmetics and cannabinoid products online.
  3. Buy gear for a home grow
    Plant Living is a Cape Town online grow store with hydroponics and lights.
  4. Leave licensed growers to business buyers
    Biotic Pharm, in Atlantis, formerly Cannsun, holds a SAHPRA cultivation and export licence to 2030 and does not sell to visitors.

The club ruling and its limits

The club was raided in October 2020, and the court found that a grow club outsources a right of private cultivation that the law does not allow to be outsourced. That reading stands until a higher court says otherwise; I could not confirm the appeal position, so check before joining anything.
