Cannabis and CBD brands in Mexico

Verdex lists 2 Mexican cannabis brands with COFEPRIS authorizations. No legal adult-use market exists; permits cover personal use and CBD foods are barred.

Mexico's Supreme Court has never created a legal seller. Its ruling of June 28, 2021 lets adults ask COFEPRIS, the health regulator, for a personal-use permit to grow and consume, and on July 7, 2026 COFEPRIS repeated that no right to commercialize, supply or distribute cannabis exists. The two companies Verdex lists hold narrower authorizations: Semillas Endémicas Mexicanna, with a 2023 COFEPRIS authorization to grow hemp up to 1% THC and make and sell CBD oil, and Xebra Brands, whose Mexican subsidiary Desart MX holds a court-ordered COFEPRIS authorization for low-THC cannabis. Verdex has verified one of the two, and marks current operations at the first as unverified.

The consequence for a shopper is that a company authorization is specific. A hemp-growing or court-ordered permit does not turn every product on a shelf into a legal one, and COFEPRIS has warned against CBD sold as food or cosmetics. Check the exact product and the seller's authorization, and treat "shops" and delivery services selling cannabis in Mexico City, Cancún or Tulum as unlicensed, because no such licence exists.

Is there a legal cannabis market in Mexico?

No. Selling, supplying or distributing marijuana remains illegal in 2026. Since a Supreme Court ruling of June 28, 2021, adults can obtain a COFEPRIS permit for personal growing and use, but the permit never covers buying or selling.

Is CBD legal in Mexico?

It is tightly restricted. COFEPRIS said in February 2025 that CBD, hemp extract and THC may not be used in foods, sweets, supplements, cosmetics or drinks sold in Mexico, and it named seven brands whose products were not authorized.

Can tourists buy cannabis at a shop in Mexico?

No lawful shop exists, because no licence exists. Shops and delivery services in Mexico City, Cancún or Tulum are selling illegally, and their products are not tested.

    Allowed only for holders of a COFEPRIS self-consumption authorization; no plant number is set in the law.

    Sale, supply and distribution remain illegal; COFEPRIS reiterated this on 8 July 2026.

  • Medical

    Legal since the 2017 reform and 2021 regulation, but no registered cannabis medicines were on sale as of 2025; access via import permits or court orders.
