Picture the offer on a Cancún beach or outside a Roma Norte bar: a vendor with pre-rolls and a line about weed being legal in Mexico now. The first half of that sentence is a sale; the second is a misreading of Supreme Court rulings. For a visitor, accepting the offer creates two problems at once, a criminal exposure and a target for anyone, police included, who wants cash.

What the court rulings changed, and what they didn't
On June 28, 2021 the Supreme Court struck down the absolute ban on recreational self-consumption in the General Health Law (Declaratoria General de Inconstitucionalidad 1/2018). The effect, per the Court's own summary, is that health authorities must authorize adults to grow and use cannabis for personal use. The authorization never covers importing, trading, supplying or selling.
COFEPRIS repeated the point in July 2026, telling Récord that the rulings create no right to commercialize, supply or distribute cannabis. Congress has never passed the legalization bill it debated in 2020 and 2021.
How much can you carry, and what happens above it?

“No charges” is not the same as no trouble. Article 478 still has the prosecutor record the case and refer you to health services, and local police and municipal civic rules on public consumption apply on top. A Supreme Court decision reported in September 2026 said carrying more than 5 g is not automatically a crime if the evidence shows personal use, but that is an argument for a lawyer, not a defense to make on the street.
Where tourists get into trouble
- Buying from vendors and taxi drivers — Every sale is illegal, and a buyer can be caught in the same arrest.
- Smoking in public — Court-backed permits exclude public places where others haven't consented; municipal rules add fines.
- THC vapes — The UK Foreign Office says it is illegal to bring vaping devices into Mexico or to buy or sell them; customs can confiscate them and fine or detain you.
- Gummies and CBD edibles — COFEPRIS says CBD, hemp extract and THC may not be used in foods, sweets, supplements or drinks sold in Mexico.
- Flying home — Carrying cannabis across a border can be prosecuted as trafficking; your home country's customs apply too.
- Bringing your own medical cannabis — Canada's advice calls Mexico's rules on medical cannabis unclear; a foreign prescription is no guarantee.
Extortion: the risk that follows cannabis
Both Canada and the UK warn that genuine police officers in Mexico have demanded cash from tourists for minor offenses, a practice Canada calls common in tourist areas. Canada's advisory adds that visitors could be arrested or extorted over cannabis specifically, and the UK warns of criminals posing as police.
Police may hold people for up to 72 hours for many petty offenses, and foreign nationals are often kept in pre-trial detention with long delays before trial, Canada says.

Cancún and Mexico City: what's different?
The federal rules above apply in both. What changes is local: each municipality has its own civic rules and fines for public consumption. We haven't found a published tourist exception in Quintana Roo or Mexico City. Resorts and Airbnb hosts set their own no-smoking rules, and the UK notes a fine of up to 3,000 pesos for smoking or vaping in public places.
