Canadian-owned CBD company whose Mexican subsidiary Desart MX holds a court-ordered COFEPRIS authorization for low-THC cannabis; brand Elements.

Xebra Brands is a cannabinoid wellness company whose Mexican subsidiary, Desart MX, holds one of the very few authorizations COFEPRIS has issued for commercial activity with cannabis in Mexico. Its consumer brand is Elements, a CBD line of capsules, tinctures, topicals and intimate oils.

The authorization came through the courts. In December 2021 Mexico's Supreme Court granted Xebra's Mexican subsidiary an injunction, holding that the ban on growing cannabis with under 1% THC was unconstitutional as applied to it. In late February 2023 COFEPRIS issued the permit, covering seed imports, cultivation, processing to extract cannabidiol oil, and commercialization of non-psychoactive cannabis, AP reported. COFEPRIS said at the time that it acted under threat of fines and removal of officials and that it did not have enough information to establish the product's safety, so the authorization was granted under protest.

Xebra's website lists a 2023 COFEPRIS full authorization, a 2025 COFEPRIS full authorization, 2024 authorizations to import CBD products for the Mexican market and two 2024 authorizations for CBD tinctures, and it publishes redacted copies of the documents. These are company claims based on its own filings; the official texts were not machine-readable for Verdex to check.

Context matters: in February 2025 COFEPRIS warned that CBD, hemp extract and THC may not be used in foods, supplements, cosmetics or beverages under the General Health Law, and named several unauthorized brands. Xebra is not among them, but buyers should expect Mexico's rules to stay contested.
