Can Cannabis Users Donate Blood in Brazil? The 12-Hour Rule

Brazil bars blood donation for twelve hours after cannabis use, not for life. What Portaria 11.685 (2026) says, how it compares with other drugs, and privacy.

Key takeaways

  • Cannabis use excludes you from donating for 12 hours from the last use; it is not a permanent bar.
  • The rule is in the Health Ministry's blood-services annex (now Annex IV-B, art. 62, §6), not in ANVISA's RDC 34/2014.
  • Portaria GM/MS 11.685, published 3 July 2026, keeps the 12 hours and takes effect around 1 October 2026.
  • Injected illicit drugs are a permanent bar; inhaled crack or cocaine means 12 months.
  • Interviews must be private and information confidential; the rule makes no exception for medical cannabis users.

Plenty of cannabis users skip blood drives because they assume a single joint disqualifies them for months, or that the clinic would report them. Neither is what the regulation says. It gives a clock of twelve hours, and it tells hemocentros to keep what donors say private.

The rule is a Health Ministry one, not ANVISA's. ANVISA's RDC 34/2014 governs good practice in the blood cycle, and the new portaria leaves it in place, Newslab reported, but the waiting periods for donors sit in the ministry's annexes.

What the text says, and how it compares with other drugs

Article 62 of the new Annex IV-B, added to Portaria de Consolidação 5/2017 by Portaria 11.685, lists the drug rules under lifestyle screening. Paragraph 6 says use of "maconha" is cause for exclusion for twelve hours counted from the last use.

UseWait before donatingWhere
Maconha (cannabis)12 hours from the last useAnnex IV-B, art. 62, §6
Crack or cocaine by inhalation12 months from the last useArt. 62, §5
Injectable hormones or anabolic steroids without a prescription4 months from the last useArt. 62, §7
Injected illicit drugs, now or in the pastPermanent barArt. 62, §4
Any other drugJudged case by case by the screening staffArt. 62, §1

The old Annex IV, which the new portaria revokes, put the same 12 hours for cannabis and 12 months for crack and cocaine in article 61. What did change in 2026 is around the edges: the steroid wait and how the interview is framed.

Is the 12 hours a test or a promise?

A promise. The rules I read screen donors by interview and require infection tests on every donation, and I found no requirement to test blood for THC. The portaria also gives no reason for the number of hours, so any explanation of why twelve is a guess.

The wording matters for one more thing. The interview must be individual, in a setting that protects privacy and secrecy (art. 36, §1), and clinics must keep what a donor says confidential, within the data-protection law (art. 33). A separate provision tells services to run the interview without prejudice over "hábitos de vida", meaning lifestyle. If a hemocentro treats you otherwise, that is a complaint to make.

The day itself

  1. Register
The service keeps a donor record that includes your ID document and CPF.
  2. Fill in the questionnaire
Services may offer a digital questionnaire, but the portaria says it does not replace the interview.
  3. Talk to the screener alone
This is where drug use is asked about. Answer with the time of your last use; the screener decides.
  4. Donate, or come back
If twelve hours have not passed, the answer is to come back once they have.

What changed in 2026

  • Health Ministry signs Portaria GM/MS 11.685, rewriting the technical rules for blood services.
  • Published in an extra edition of the Diário Oficial; it takes effect 90 days after publication.
  • Blood services such as Hemoba in Bahia say they adopt the new criteria from this date.

The same portaria removes the upper age limit for regular donors after 70 with a medical check, and shortens waits after tattoos and piercings to as little as seven days when done in a compliant place, Acorda Cidade and Hemoba reported. Cannabis rules did not change.

If you smoke or vape the evening before, the ordinary sequence is to wait and donate after the twelve hours have run. That is not detection time: how long THC stays in your body is a different, much longer question. For the legal position on personal use, see the STF 40-gram ruling, and for what Verdex lists in the country, the Brazil hub.

Nothing here is medical or legal advice. Ask your local hemocentro for its exact screening rules; the Ministry of Health publishes the portaria at bvsms.saude.gov.br.

FAQ

Quem fuma maconha pode doar sangue no Brasil?

Yes, after twelve hours from the last use. Portaria GM/MS 11.685 of 2 July 2026, Annex IV-B, art. 62 paragraph 6, says use of maconha is a cause of exclusion for twelve hours counted from the last use.

Will the hemocentro test me for THC?

The rules I read screen donors by interview and require infection tests on each donation. I found no requirement to test donated blood for THC.

Will they report me to the police for admitting cannabis use?

The portaria requires private interviews and confidentiality of donor information under the data-protection law (arts. 33 and 36). It does not describe any reporting to the police.

Can I donate if I use medical cannabis oil?

The rule does not distinguish medical from recreational use and does not mention CBD medicines. The screening team assesses your medication history, so ask the hemocentro before you go.

When do the new blood donation rules start?

Portaria 11.685 was published on 3 July 2026 and takes effect 90 days later, around 1 October 2026. Some state blood centres, such as Hemoba in Bahia, announced they will adopt it from 1 October.
