One milligram is the most THC or other controlled cannabinoid a single container of a UK CBD product may hold before it becomes a controlled drug, under the Home Office's exempt-product rules. That limit, not the "0.2% THC" on many websites, is the test. Verdex lists two UK CBD brands: Love Hemp, an online shop and brand in Watford stocked by Boots and Holland & Barrett, and Naturecan, a Stockport-based brand founded in 2019 selling oils with non-detectable THC. Both are noted as having FSA-listed products. Prescribed cannabis is a separate system, and no UK shop may sell THC cannabis.

- Find the exact product on the FSA public list. In England and Wales a CBD food may stay on sale only if it appears there, and an oil on the list does not cover a gummy from the same brand.
- Check THC per container. More than 1 mg of controlled cannabinoids makes a product a Class B drug unless it meets all three limbs of the exempt-product definition.
- Compare the dose with the FSA's advice. The agency advises healthy adults to take no more than 10 mg of CBD a day, and advises against CBD for under-18s, people who are pregnant or breastfeeding and people taking medication.
CBD flower for smoking is different: raw hemp flower is controlled under the Misuse of Drugs Act 1971, so "legal CBD buds" can be seized. Scotland and Northern Ireland differ on food rules; Northern Ireland follows EU rules, under which no CBD food is authorized.
The regulatory clock moved on September 15, 2026, when an FSA board paper recommended that ministers authorize three high-purity CBD ingredients, linked to about 3,000 listed products. Until ministers decide, listed products stay unauthorized. EFSA's February 2026 figure of 0.0275 mg per kg a day, about 2 mg for a 70 kg adult, is much lower than the FSA's 10 mg. Is CBD legal in the UK?
Yes, within limits. In England and Wales, CBD foods may stay on sale only if they are on the Food Standards Agency's public list, and any product must hold no more than 1 mg of THC or other controlled cannabinoids per container, according to the Home Office factsheet.
Can I buy CBD flower legally in the UK?
No. Raw hemp flower remains a controlled drug under the Misuse of Drugs Act 1971, and police can seize 'CBD buds'. Only narrow cases, such as individually labelled tea servings under 1 mg controlled cannabinoids each, are allowed by the Home Office.
How much CBD does the FSA recommend?
The FSA advises healthy adults to take no more than 10 mg of CBD a day, and advises against it for under-18s, people who are pregnant or breastfeeding and anyone on medication. In February 2026 EFSA set a far lower provisional figure of about 2 mg a day for a 70 kg adult.

Illegal. Cannabis is Class B, with a maximum of five years' imprisonment and/or an unlimited fine; for possession, police may instead give a warning or a penalty notice of up to £90 on the spot.
Prescribed cannabis
Legal when prescribed by a doctor on the GMC Specialist Register and dispensed by a registered pharmacy.
Home grow
Illegal. Growing counts as production of a Class B drug, with a maximum of 14 years in prison; a prescription does not permit cultivation.
Public use
Using non-prescribed cannabis anywhere is illegal, and prescribed cannabis-based products must not be smoked.
