CBD Oil in Portugal 2026: Why Bottles Are Being Seized
Three enforcement waves since January say the same thing: CBD sold as food or supplement is treated as unauthorised. What that leaves a buyer with.
This guide is about Portugal — not the country you picked in the header.

Key takeaways
- ASAE says food products, including supplements, containing CBD or other cannabinoids may not be sold because they are an unauthorised novel food.
- In January 2026 ASAE seized 3,588 items from six operators in Porto, Braga, Aveiro and Guimarães; in May 2026 Operation Euforia seized 6,822 items from 53 businesses.
- Seizures included pharmacies, supermarkets and websites, so the label on a pharmacy shelf is not a guarantee.
- CBD as an authorised medicine, such as an epilepsy solution, is dispensed against prescription.
If you searched 'CBD Portugal' this year you probably landed on webshops that ship a dropper bottle in two days. Those bottles are the target. Since January ASAE has said in plain words that extracts with cannabinoids, CBD included, cannot be used as a food ingredient or additive.
Three waves since January
ASAE reports 3,588 items seized from six operators in Porto, Braga, Aveiro and Guimarães: flowers, leaves, resin, hashish, pollen and foods. Six criminal proceedings for trafficking and food-composition offences.
Operation Euforia: 53 operators inspected, 6,822 items seized, 19 criminal cases, 8 administrative cases. Seeds, flowers, resin, gummies, lollipops, chocolates, pasta and infusions.
Further visits to CBD shops in central and northern Portugal by ASAE, the Judiciary Police and the labour inspectorate, reported by CannaReporter. That outlet says many of the seized items (teas, wines, lollipops made with hemp seed) contained no cannabinoids, that ASAE gave it no comment, and it disputes the legal basis; treat this wave as contested.
For the operation in detail and its criminal cases, see our news report on Operation Euforia. For the shop side, see CBD shops in Lisbon and Porto.
Which sales channel carries what risk
| Where you buy | How the authority treats the product | What to do |
|---|---|---|
| CBD shop or herbalist | Oils, gummies and teas sold to eat are a food problem; flowers and resin are treated as psychoactive plant material | Expect stock to be seized; ask for nothing you would eat |
| Pharmacy or parapharmacy | Targeted in Euforia: not a safe harbour for supplements | A shelf position proves nothing; a prescription medicine does |
| Webshop | Websites were named as targets in May 2026 | Foreign sellers shipping in have no Portuguese approval to rely on |
| Prescription medicine | Authorised medicines follow the medical route | Ask a doctor; see the medical guide |
If you already use CBD oil
- Read the label as a food or cosmetic: if it says supplement, it is what ASAE is targeting; if it says cosmetic, Infarmed's circular of 14 February 2022 bars CBD and cannabis extracts, tinctures and resin from cosmetics whatever their THC level; only substances from the seeds of low-THC varieties are left.
- Medicines: if you take other prescription drugs, talk to your doctor first: CBD interacts with some, see side effects and interactions.
- Batch report: a genuine seller shows a certificate of analysis for the batch; how to read one.
- Prescription route: for a diagnosed condition, ask your doctor about the Infarmed-authorised medical route.
FAQ
Is CBD oil legal in Portugal?
ASAE says food products, including supplements, with CBD or other cannabinoids may not be sold because they are an unauthorised novel food. Authorised medicines containing CBD go through prescription.
Can I buy CBD oil at a Portuguese pharmacy?
Pharmacies and parapharmacies were among the businesses inspected in Operation Euforia, so a pharmacy shelf is not proof that a supplement is authorised. Prescription CBD medicines are separate.
What did ASAE seize in 2026?
3,588 items from six operators in January, and 6,822 items from 53 businesses in Operation Euforia in May, including flowers, resin, gummies, chocolates and infusions.
Can I order CBD oil online from another EU country?
Websites were targets in May 2026, and the Portuguese authority treats CBD foods as unauthorised regardless of where the seller sits. Check whether a product is authorised as a medicine before ordering.
Are hemp seed oil and CBD oil the same?
No. Hemp seed oil is pressed from seeds and contains little or no CBD. Infarmed's circular of 14 February 2022 bars CBD and cannabis extracts from cosmetics, leaving only substances from the seeds of low-THC varieties.
