Key rules in Colombia

Plain-language summary. The regulator is Ministerio de Justicia y del Derecho.

  • Possession

Personal dose of up to 20 g of marijuana or 5 g of hashish (Law 30 of 1986); courts weigh intent to consume. Selling is a crime.

  • Home grow

Personal self-cultivation is outside the licensing regime if nothing is supplied to others (Decree 1138 of 2025); the commonly cited ceiling is 20 plants.

  • Public use

Regulated locally; cities such as Bogotá and Medellín restrict use near schools, parks and similar places.

  • Police seizure

Decree 2114 of 2023 repealed Decree 1844 of 2018, which had allowed police to confiscate personal doses, according to legal summaries.

  • Medical access

Prescription required; THC products are usually dispensed as magistral preparations by INVIMA-certified pharmacies.

  • Dried flower

Decree 1138 of 27 Oct 2025 allows medical flower as a finished product; implementing rules were still being finalized in 2026.

How it works

How cannabis is sold in Tocancipá

The risk in Tocancipá is a brand you cannot trace back to a licence.

  • Ask which licence. Decree 613 of 2017 separates seed, psychoactive cultivation, non-psychoactive cultivation and derivative manufacture, each for national use, export or research.
  • Match the address. Clever Leaves lists Bodega 19-B and Bodega 60 at Parque Industrial Tibitoc, Tocancipá. Its cultivation is in Pesca, Boyacá, a different municipality.
  • Ask for the GMP paper. The company describes the plant as EU-GMP certified; a buyer can request the certificate.
  • Remember there is no counter. Verdex lists Clever Leaves as a producer of pharmaceutical-grade flower and extracts, not a shop. Press coverage describes the Tocancipá site as its technological extraction and production laboratory.

What does the plant do?

Cundinamarca also hosts FoliuMed at Nemocón, another licensed producer. Press reports say the company centres its operations on Pesca and Tocancipá, has invested more than US$50 million, and provides more than 600 formal jobs across the two. In 2023 it sold processing assets in Portugal to a Curaleaf subsidiary and refocused on Colombia, according to Yahoo Finance.

Where do patients come in?

Through a doctor and a pharmacy, not through the plant. The Colombian pharmacy guide lists what dispensing looks like.
