What does Decree 1138 change?

It amended Decree 780 of 2016 to regulate access to the cannabis plant and its flower for medical purposes, and it requires magistral preparations to use raw material from licensed Colombian crops. The practical piece — which flower products are allowed, for which conditions and how pharmacies deliver them — was left to INVIMA.

The decree also bars imported derivatives from magistral preparations, except homeopathic ones, which is why compounding pharmacies such as LABFARVE work with Colombian-grown raw material. Patients covered by an EPS (the public health insurers) may get part of the treatment through their insurer, depending on the clinic.

Rules for visitors

Possession law is more relaxed than sale law. According to Radio Nacional, a 2021 Supreme Court ruling said the crime is defined by purpose, not quantity, so carrying more than the 20 g dose for your own use is not automatically trafficking.

Not for recreational sale. Possessing a personal dose of up to 20 g isn't a crime, and courts have said purpose matters more than quantity, but buying and selling remain illegal outside the medical system.

Where can you buy medical cannabis in Bogotá?

With a prescription, from certified pharmacies that prepare magistral cannabis products, such as LABFARVE, or clinics with their own pharmacy like Clínica Zerenia. CBD cosmetics with an INVIMA registration are sold without prescription.

Can pharmacies in Colombia sell cannabis flower?

Decree 1138 of October 2025 allows prescribed flower in principle, but INVIMA's technical rules had not been issued as of May 2026. Until they are, pharmacies work mainly with oils and other magistral preparations.
