Key rules in Brazil

Plain-language summary. The regulator is ANVISA (Agência Nacional de Vigilância Sanitária).

  • Possession

Up to 40 g or six female plants is presumed personal use (STF, 26 June 2024): administrative warning and educational measure, no criminal record; police may still seize.

  • Home grow

Not authorized outside individual court orders (habeas corpus); the six-plant figure is a presumption for policing, not a permission.

  • Sales

Only prescription cannabis products in pharmacies and drugstores (RDC 1.015/2026); any other sale is trafficking.

  • Medical

Prescription by physicians or dentists; special-control form up to 0.2% THC, A notification above; personal imports under RDC 660/2022.

  • CBD

No over-the-counter CBD; CBD products are prescription-only and must be ANVISA-authorized or imported under RDC 660.

  • Cultivation

Companies with ANVISA Special Authorization may grow cannabis under 0.3% THC for medical and pharmaceutical use (RDC 1.013/2026).

  • Associations

Non-profit patient associations have a specific ANVISA framework (RDC 1.014/2026) that bars commercial sale; 47 grow under court orders.

How it works

How cannabis is sold in Toledo

Are there cannabis shops in Toledo?

No. Verdex lists no dispensary here, only a manufacturer: Prati-Donaduzzi, whose Anvisa-authorised canabidiol oral solutions, at 20, 50 and 200 mg/mL, reach patients through pharmacies on prescription.

What makes the Toledo product different?

Trade press describes it as the first and, at the time, only cannabidiol product with Anvisa authorisation, produced entirely in Brazil from an isolate imported from Europe. The company says it makes about 13 billion doses a year and reports a planned new factory for solid medicines in Toledo.

Is possession a crime?

Not for personal use. The Supreme Court decided on 26 June 2024 that up to 40 grams of cannabis, or six female plants, is presumed personal use and treated as an administrative matter, though police may still seize it and act on other signs of trafficking.

Did Anvisa change anything in 2026?

Yes. New rules approved in January 2026 replaced resolution RDC 327/2019 and allow legal entities to cultivate for pharmaceutical and scientific use, allow compounding pharmacies to sell cannabidiol formulations, and permit exports of Brazilian-made products. Toledo's role is unchanged: the city hosts a manufacturer with a pharmacy-channel product, not a retail market, and Verdex lists it under brands for that reason. Nationwide rules are on the Brazil page.
