Luxembourg's Home-Grow Law: What's Legal for Residents and Visitors

Four plants per household, use at home only, and a €145 warning for small amounts outside. Luxembourg's 2023 law is narrower than headlines suggest, especially for visitors.

Headlines in 2023 said Luxembourg had "legalized cannabis." What it actually legalized is a private garden: four plants, one household, consumption behind your own front door.

That makes the law useful to residents who grow and almost irrelevant to visitors. Here is what is allowed, what the penalties are, and why the retail market promised in 2018 never arrived. This is general information, not legal advice.

What does the 2023 law allow?

The law amending the drug act of February 19, 1973 lets any adult grow cannabis at home under four conditions set out by the Ministry of Justice.

  1. Four plants per household
    The limit is per "domestic household": everyone living together and sharing a household budget. On the ministry's definition, two adult flatmates with separate budgets would count as two households, though the ministry gives no such example.
  2. At your home or habitual residence
    Indoors or outdoors, but only where you live.
  3. From seed only
    Cultivation must start from seeds; seeds must be labeled with the producer, seed count and a health warning, according to the Grand Ducal Police.
  4. Out of public view
    Plants must not be visible from public space.

Adults may consume the home-grown cannabis at home. They may not share it with anyone outside the household, and use in front of minors is a separate offense.

Penalties: what happens outside the home

The law reduced penalties for small amounts but kept every activity outside the home illegal.

The €145 taxed warning is the lighter option; the alternative is a criminal fine of €25 to €500 set by a court, and the 2023 law replaced the earlier, harsher penalties for up to 3 g, according to the law firm CMS.

Can visitors use cannabis in Luxembourg?

Not legally in practice. Buying cannabis is illegal for everyone, there are no shops or clubs, and use is only allowed at the place of cultivation.

A visitor staying with a Luxembourg household that grows could in theory consume at that home, since the law allows adults to use at the grower's residence. But the household may not share its harvest with people outside it, and a guest is not a household member. Carrying any cannabis into Luxembourg from Belgium, France, Germany or the Netherlands is transport of a controlled drug.

  • No purchase — there is no legal seller, and buying from a dealer is an offense.
  • No carrying in — German club cannabis or a Dutch coffeeshop purchase is not legal in Luxembourg.
  • No public use — parks, cafés, hotel terraces and cars are all outside the home.
  • Seeds — seeds are sold in Luxembourg for home growers; they only help if you have a residence there.

Cross-border workers and weekend visitors

Luxembourg's economy runs on commuters from France, Belgium and Germany, and all three neighbors treat cannabis differently. None of that travels with you. A German commuter who can legally carry 25 g at home commits an offense by bringing any of it to work in Luxembourg, and a Luxembourg resident who drives to Metz or Arlon with home-grown buds is transporting cannabis out of the home and into France or Belgium.

The same applies in the other direction: residents may not bring home cannabis bought in a Dutch coffeeshop or a German club, even for use in their own living room.

The home-grow law was presented as stage one of a larger plan that stalled.

  1. Law on medical cannabis passed; prescriptions dispensed by hospital pharmacies from 2019.

  2. Government announces plans for home growing and lower penalties as the first step of a pilot for legal non-medical access.

  3. Home-grow and reduced-penalty law takes effect.

  4. New coalition agreement for 2023–2028 keeps home growing and says the government will observe the position of the three neighboring countries, according to the Health Ministry's portal.

  5. High-THC flower withdrawn from the medical program; oils remain.

We found no announced start date for state-controlled sales in September 2026. That leaves Luxembourg between its neighbors: stricter than Germany, where adults can join resident clubs and carry 25 g, and looser than France and Belgium.

How Luxembourg compares with other home-grow countries

Luxembourg allows more plants than Germany or Czechia but is the only one of the four that bans carrying any amount in public.

The per-household limit is the detail that trips up shared homes. A family of four adults in Germany could grow twelve plants; in Luxembourg the same family is limited to four.

A home grower's compliance check

  • Count the household, not the adults — four plants total for everyone sharing a budget.
  • Grow where you live — not at a garden plot, a second property you do not live in, or a friend's flat.
  • Screen the plants — balconies and gardens visible from the street break the rule.
  • Keep seed packaging — seeds must carry the producer's name, seed count and a health warning.
  • Keep the harvest at home — taking it to a friend's place is transport.

Medical cannabis: hospital pharmacies, fewer flower options

Luxembourg's medical program is separate from the home-grow law and runs through hospital pharmacies.

  • Legal basis: law of July 20, 2018; the access program opened in February 2019.
  • Conditions: severe chronic pain in advanced or terminal disease, nausea from chemotherapy and multiple sclerosis spasticity.
  • Where dispensed: hospital pharmacies, as magistral preparations on prescription.
  • 2025 change: high-THC flower withdrawn from January 2025, citing dosing and misuse concerns; THC-rich oils stay available, per the WHO's health-systems monitor.
