CBD Oil in Australia 2026: Prescription vs the Pharmacy Route

Pharmacists have been allowed to sell low-dose CBD without a script since 2021. As far as we can find, that route is mostly theoretical, because no approved product has reached shelves.

150 milligrams a day. That was the ceiling the Therapeutic Goods Administration (TGA) set on December 15, 2020, when it announced that low-dose CBD could move from prescription-only (Schedule 4) to pharmacist-only (Schedule 3). The change took effect in February 2021, and it is why "CBD oil over the counter in Australia" is still a common search.

What the announcement also said, in the same release, was that no approved product met the Schedule 3 criteria. A rule that needs an approved product is only as useful as the products that pass. Here is how both routes work in 2026 and which one gets you CBD.

Route 1: the prescription (the one that works)

Most Australians who use CBD oil get it this way. According to the TGA, any registered doctor can apply to prescribe unapproved CBD, and nurse practitioners can apply through SAS Category B.

  1. Book a consultation
    Your GP, a specialist or a telehealth clinic. The prescriber decides whether CBD is clinically appropriate.
  2. The prescriber picks a category
    Since November 22, 2021 applications are made by product category, not brand. Category 1 means CBD makes up at least 98% of total cannabinoids; those products are Schedule 4, the TGA says.
  3. Approval under SAS-B or an Authorised Prescriber
    Unapproved products need a Special Access Scheme Category B approval for you, or a prescriber with Authorised Prescriber status.
  4. A pharmacy dispenses it
    The prescription names the product, strength, dose and quantity. You pay the full price.

The only CBD medicine registered on the ARTG for specific conditions is Epidyolex, used for certain severe childhood epilepsies, and it is the only cannabis medicine we found subsidized on the PBS, where the listing covers Dravet syndrome. Everything else is out-of-pocket.

Route 2: the pharmacist-only S3 rule, and why shelves are empty

The rule exists; the products mostly do not. To be sold as Schedule 3, a CBD product must clear conditions set out in the TGA's 2020 decision.

  • TGA-approved and on the ARTG — evaluated for safety, efficacy and quality, like any over-the-counter medicine.
  • Low dose — no more than 150 mg of CBD a day.
  • Adults only — 18 and over.
  • Limited packs — dosage-form and pack-size limits, with child-resistant closures.

The TGA says each application is evaluated individually for safety, efficacy and quality. Industry and regulatory commentary through 2026 reports that no S3 CBD product has reached general pharmacy sale, and we have not found an ARTG listing that changes that. If one launches, it will carry an AUST R number on the pack, which is how to recognize it.

Hemp seed oil is not CBD oil

Supermarket hemp oil is a food. Food Standards Australia New Zealand amended the Food Standards Code in 2017 to allow low-THC hemp seed foods.

FSANZ says hemp seeds contain protein, minerals and omega-3 fatty acids, and that hemp has no therapeutic effect because its cannabidiol levels are low. Labels that imply a hemp seed oil will treat pain, sleep or anxiety are a warning sign, not a feature.

Buying CBD online from overseas

Ordering CBD oil from a foreign website for personal use is importation of an unapproved medicine. It is the route with no checks on dose, THC content or contaminants, and the TGA has taken action against businesses advertising unapproved cannabis products to Australians.
