Adults have been able to grow cannabis at home since the Constitutional Court's Prince judgment of September 18, 2018, yet the Act meant to put limits on it has no start date. Act 7 of 2024, the Cannabis for Private Purposes Act, was signed in May 2024, and Verdex found no commencement proclamation as of September 27, 2026. Two grow shops are listed.
Grow Guru, established in 2012, has stores in Johannesburg and Gqeberha and delivers hydroponic gear nationwide. Plant Living is a Cape Town online store selling AutoPot systems, lights and harvest tools from Cape Town and Johannesburg. They sell equipment; nobody may sell you cannabis.

Draft limits, private places and the public-use line
Draft regulations published on February 2, 2026 propose 750 g and five plants per adult, whatever the plant's size. Comments closed on March 5, and Parliament must approve the final figures, so treat both as unofficial.
| Offence under the Act | Maximum penalty |
|---|---|
| Dealing: selling, buying, advertising, growing to sell | Fine or up to 10 years |
| More than the prescribed plants or amount | Fine or up to 5 years |
| Use in public, in a vehicle, or near a neighbour's window or door | Fine up to R2,000 |
| Not storing cannabis out of children's reach | Fine up to R2,000 |
A "private place" is any building, shed, tent, boat or land the public cannot access as of right, and the cannabis must be concealed from public view. Giving cannabis to another adult is allowed only if nothing changes hands in return: a favour counts as payment. A police moratorium since August 23, 2023 bars arrests of adults for private use and cultivation, according to the Human Rights Commission, though arrests continued in 2024.
Our guides explain the Act's home and public rules and why cannabis dispensaries remain a grey market.
