Belgian CBD shops can sell hemp flower below 0.3% THC plus THCA as a notified smoking product, but not CBD food, supplements or vape liquid.

Three regulators, three sets of rules: a jar of hemp flower on a Belgian shop counter has to satisfy all of them at once. A product that is fine under the drug law can still break food law on the same afternoon.

The threshold is the sharpest change. VAD describes the 0.3% figure as aligned with the EU hemp cultivation rules, and the Royal Decree that set it was published in the Belgisch Staatsblad on 22 May 2024. Sources from before June 2024, such as the BCFI's 2019 review, still say 0.2%.

The hemp seed rule is Belgian as well as EU-wide. FAGG's page of 2 February 2026 says hemp seed oil and seed extracts are allowed in food and cosmetics under the names "hemp seed oil" or "cannabis sativa seed oil". VAD adds that, under the Plant Commission's advice of 4 April 2022, each lot needs an analysis certificate showing THC within EU limits (3.0 mg/kg for seed, 7.5 mg/kg for seed oil).

Checklist before you buy

  1. Ask for the certificate
    A batch-specific lab report showing THC and CBD. VAD says the notification file must contain an analysis certificate showing THC below 0.3%.
  2. Check the THC figure
    It must be below 0.3%. Some sellers still quote the older 0.2% figure, which was the line until 1 June 2024.
  3. Look at the labelling
    Health claims are a red flag: FAGG says a smoking product may make no therapeutic claim, and VAD says such a label puts the product under medicines law.
  4. Keep the paperwork
    If you carry flower, a receipt and the certificate help when a police officer cannot tell hemp from cannabis by smell.

French-speaking towns account for most of the named-city demand, with Ghent (200) the Flemish exception. Demand is high enough that a shopper should treat "every town has one" as a reason to check the certificate, not to skip it.
