Ask what the law says about a joint and you will get two honest answers in Ireland: it is a crime, and it is unlikely to end in a criminal record for a first-time adult. Both are true, and the gap between them changed again on 1 September 2026.

What the Gardaí say is banned

The Garda public guidance answers plainly: it is an offence to cultivate, import, export, produce, supply and possess cannabis except in accordance with a ministerial licence. It adds that no licences have been issued for medical cultivation. The same page says CBD is not controlled, while any product containing THC, gummies and cookies included, is illegal.

Penalties on paper: a fine for a first personal-use offence, life for supply

Section 27 of the 1977 Act sets the ceilings, and the Law Reform Commission's revised text (updated to 29 July 2026) shows how much they vary. For simple possession under section 3 of cannabis or cannabis resin that the court accepts was for personal use, a first offence carries a fine only. A second offence is also a fine. Only a third or later offence can bring up to 12 months on summary conviction or up to 3 years on indictment.

The EUR 13,000 threshold was inserted in 1999 and converted to euro in 2002, and the fine ceilings in the personal-use rows are the Law Reform Commission's translation of the original pound amounts under the Fines Act 2010. Most people never see the higher ceilings. The cases that reach a judge tend to involve quantity, cultivation or supply.

The gap between the statute and a first offence

Is anything about to change?

Not the offence. The Gardaí say the Government has no plans to legalize cannabis, and I found no legalization bill in the sources I opened. What is moving is the way cases are handled (the HSE referral, launched by the Departments of Health and Justice with the Director of Public Prosecutions' approval) and the medical programme (the Allwright review, which the Department says will run no longer than 12 months from its first meeting). Both can change outcomes for individuals without altering the law that makes cannabis illegal.

Four bodies you might meet: the Gardaí for offences, the HPRA for medicines and controlled-drug licences, the HSE for referrals and the medical register, and the FSAI for food and CBD.

Common mistakes visitors and residents make

  • Assuming CBD means cannabis is fine. CBD is not controlled, but a product with THC is; read the certificate.
  • Assuming a caution is a right. A garda superintendent decides, after the person admits the offence, and weighs the type, quantity and value of the cannabis and the person's history.
  • Driving after edibles. The Gardaí say a positive roadside intoxication test can lead to charges.

Is weed legal in Ireland?

No. It is an offence to cultivate, import, export, produce, supply or possess cannabis without a ministerial licence, according to the Gardaí.

Is cannabis decriminalized in Ireland?

No. Possession remains a criminal offence under section 3 of the Misuse of Drugs Act 1977. Diversion routes exist: an adult caution for simple cannabis possession for offences after 14 December 2020, and an HSE referral for eligible first-time offenders since 1 September 2026.

How much cannabis can you have in Ireland?

There is no legal amount. Quantity affects whether gardaí treat the case as simple possession or supply, and for the adult caution gardaí must consider the type, quantity and value of the cannabis. No gram threshold is published for the HSE referral; the Minister told RTÉ it is for gardaí to decide what a small quantity is.

Can I grow cannabis in Ireland?

No. Cultivation needs a ministerial licence, and the Gardaí say none has been issued for medical cultivation.
