Is Weed Legal in Greece? What Tourists Risk in 2026
Greece has no tourist exception: personal-use possession carries up to five months under Article 29, a judge can waive it, and hemp flower retail has been banned since May 2026.
This guide is about Greece — not the country you picked in the header.

Key takeaways
- Cannabis is illegal in Greece for everyone; personal-use possession or growing carries up to 5 months in prison (Law 4139/2013, Art. 29).
- A court may exempt a one-off, incidental offender, and such convictions are not shown on the usual criminal-record extracts (Art. 29(2)-(3)).
- Supply is a felony (Art. 20: at least 8 years and a fine up to EUR 300,000); unpaid sharing with close acquaintances is a lesser offense of up to 3 years (Art. 21).
- Law 5302/2026, Article 43, banned retail sale of hemp flower (THC up to 0.3%) from 20 May 2026, so CBD shops are no legal substitute.
- Only prescribed medical cannabis is legal; I found no rule that recognizes a foreign prescription.
A joint on a Cycladic beach and a joint in a Thessaloniki flat sit under the same paragraph of the same statute. Greece has no tourist exception, no tolerated zone and no fine-only ticket for small amounts. What it has is a low ceiling for personal use and a wide gap between that offense and supplying other people.
Ahrefs estimates about 1,300 US searches a month for the question, and many of the answers online are written by CBD sellers. This one is built from the consolidated statute text, the text of Law 5302/2026 and the regulator's and ministry's own notices. It is general information, not legal advice; the official texts are in Government Gazette A' 74/2013 and A' 78/2026.

What the statute says about a few grams
Article 29 of the drug law covers people who hold or grow a narcotic "in quantities justified only for individual use". The penalty is imprisonment of up to five months. The judge is told to weigh the type, purity and quantity of the substance, and also how often the person uses, for how long, the daily dose and any particular needs.
Two softening provisions follow. Under paragraph 2 a court may declare the offender exempt from punishment if the act was entirely incidental and unlikely to happen again. Under paragraph 3, convictions under paragraph 1 are not entered on the copies of the criminal record that get issued for jobs and permits. The consolidated text on Lawspot shows Article 29 unchanged since 2013, and I found no 2025 or 2026 amendment.
| Situation | What the law provides | What is still unclear |
|---|---|---|
| A few grams, clearly for yourself | Up to 5 months; court can exempt a one-off case (Art. 29) | No fixed gram threshold; the judge weighs purity, quantity and use history |
| A plant or two on a balcony | Cultivation for personal use falls under the same 5-month ceiling | Where "personal" ends and a grow becomes commercial is decided case by case |
| Selling, or holding stock for others | Trafficking under Art. 20: a felony with at least 8 years and a fine up to EUR 300,000; the act list includes sale, offer, storage, possession and import | Aggravated cases (Arts. 22-23) go higher; get advice from a Greek lawyer |
| Sharing a joint unpaid with a friend | Art. 21: up to 3 years where a user gives drugs without profit to close acquaintances for their immediate use, or passes on part of their own supply | Where sharing ends and supply begins is a matter for the court |
| Prescribed medical cannabis from another country | No Greek rule I could find recognizes a foreign prescription; import is one of the trafficking acts listed in Art. 20(2) | In July 2024 the health minister said a decision for visiting patients was planned; I found none published |
How much of "up to five months" do people actually serve?
I could not find published sentencing statistics for Article 29 cases, so I will not pretend to a typical outcome. The statute itself invites leniency in paragraph 2, but that is discretion, not entitlement, and a judge can weigh the purity and quantity against you.
One practical point follows from the wording. Because the test is "justified only for individual use", a quantity that looks like stock for friends, scales or a bag divided into portions moves the case toward supply. That is where the serious exposure begins: Article 20 starts at eight years.
Why the CBD shop on the corner is not a loophole any more
Until this spring the answer to "so where do tourists get something legal?" was a CBD shop selling hemp buds under 0.2% THC. Parliament voted Law 5302/2026 on 15 May 2026 and it was published in Government Gazette A' 78 on 20 May.
Article 43 raises the hemp limit in the drug law from 0.2% to 0.3% THC and, in a new paragraph 3A of Article 1, bans retail sale, distribution to consumers, purchase and use of dried flower from those low-THC hemp varieties. EOF says the ban applies whatever the THC or cannabinoid content. Wholesale of flower meant only for industrial processing is left alone.
What that means for a buyer is spelled out in our guide to what is still legal after the 2026 hemp flower ban. Short version: do not treat a shop sign as a legal opinion.
Medical cannabis exists, but it does not travel
Greece does have a working medical channel, described in our explainer on getting a Greek prescription. It rests on Greek specialists and Greek pharmacies. Health Minister Adonis Georgiadis said in July 2024 that a ministerial decision would let visiting patients get their treatment in Greece, but I found no published decision as of September 2026, and no EOF page that recognizes a foreign prescription. Until one appears, plan on none.
Verdict
Assume no leniency for being a tourist and no legal source on the island. If police stop you, the case turns on quantity and evidence of supply, so do not carry more than personal use in any circumstance. The only clean legal route is a Greek prescription from one of the five specialties.
FAQ
Is weed legal in Greece for tourists?
No. Tourists are treated under the same rules as residents: possessing cannabis for personal use is punishable by up to five months in prison under Article 29 of Law 4139/2013, although a court may waive punishment for a single incidental offense. Supplying others starts at eight years under Article 20.
Can you smoke weed in Greece if you have a medical card from home?
No. I found no Greek rule that recognizes a foreign medical card or prescription, and Greek pharmacies dispense on Greek electronic prescriptions from five specialties. The health minister announced in July 2024 that a decision for visiting patients was planned; none had been published by September 2026.
Is weed legal in Athens or on the islands like Mykonos and Crete?
No. The law is national. Nothing in Greek statute makes Athens, Mykonos, Crete or any other place a tolerated zone.
Are CBD shops in Greece legal in 2026?
Shops selling dried hemp or CBD flower are not: Article 43 of Law 5302/2026, in force since 20 May 2026, bans retail sale of flower from hemp varieties up to 0.3% THC. A Health Ministry circular of 15 September 2026 adds that retail products carrying THC (other than pharmaceutical cannabis), THC foods and cannabinoid vapes are also unlawful; CBD products face separate rules.
Does a Greek drug conviction for personal use appear on a criminal record?
Article 29 provides that convictions for personal-use possession are not entered on the copies of the criminal record normally issued to employers and authorities.
