Summary
Exclusive Hemp Farms, addressed by the FDA together with the Oshipt website, received a joint FDA–FTC warning letter dated June 29, 2023. The FDA letter gives a Gilroy, California address; the FTC's announcement also lists Etienne-DuBois, LLC/Oshipt of Henrico, Virginia, as a recipient of the same letter. According to the FDA, the two websites sold delta-8 THC edibles including 'Oreo Stoneo', 'Trips Ahoy' cookies, 'Pot Tarts' and a 'Tropical Sour Patch' product, which the agency said copy the look of Oreo, Chips Ahoy, Pop-Tarts, Sour Patch Kids and Cheez-It packaging. The FDA considers delta-8 THC an unsafe food additive and warned that look-alike packaging could lead children or unsuspecting adults to eat THC by mistake. The FTC said the practice may be unfair under the FTC Act. In July 2024, the FDA reported that the six companies warned in 2023 no longer stocked such products.

No close-out letter was noted on the FDA letter page when checked in September 2026. The FDA letter names the recipient 'Exclusive Hemp Farms/Oshipt.com'; the FTC lists 'Exclusive Hemp Farms' (Gilroy, CA) and 'Etienne-DuBois, LLC/Oshipt' (Henrico, VA) for the same letter.
